Mr. Hawkins, from the committee appointed to conduct (he balloting
for Gi v-'.mor o'" the State, reporte d that no person in nomination had re¬
ceived a majority ot votes; in which report the Senate concurred.
On motion oi" Mr. Hawkins, ordered, that a message be sent to the
House of Commons, proposing tiiat another balloting be had immedi¬
ately for Governor of the State.
Mr.. Morris presented the petition of sundry citizens of the county of
Anson, pfayieg the passage oi' an act to permit Ralph Freeman, a freeman
of color of said county, to exercise the functions and privileges of a.
preacher of the Gospel. On motion of Mr. Morris, ordered, that the said
petition be referred to the committee on piopositions at d grievances.
Mr. Martin, from the committee on claims, to u bom was referred the
r ‘it ion of William Keath, praying to have issued to him a grant for six
i 'md and forty acres oflar.d, in the county of New Hanover, made a

u hie report thereon, accompanied by the following resolution, to wit:

the- Surveyor, made on the 4th of February, 1826;”
W I rich was read the first, second and third times and passed, and ordered
to be engrossed.
Received from the House of Commons a message, agreeing to the pro¬
position of the Senate to ballot again immediately for Governor of the
State, and informing that David L. Swain is added to the nomination;
at id stating further, that Messrs. Gwyn and Hartley attend the Senate to
conduct the balloting on the part of that House; whereupon Messrs. Wil¬
son and Harrison were appointed to conduct the balloting on the part of
the Senate, ' and the House of Commons was informed thereof by mes¬
sage.
Mr. Montgomery, of Hertford, from the committee on propositions and
grievances, to whom was referred the bill to restore John Bates, of Ma¬
con county to credit, reported the same without .amendment, and recom¬
mended that it be passed into a law; whereupon the said bill was read
the second and third times and passed, and ordered to be engrossed.
Mr. Montgomery, of Hertford, from the same committee, to whom was
referred the petition of sundry citizens of the county of Wilkes, praying
the passage of an act. to restore to tile privileges ol’ a citizen, Joshua Fin-
ion, of said county, made a favorable report thereon, accompanied by a
bill, entitled, “a bill to restore Joshua. Pinion, of Wilkes county to credit:”
which was read the first, second and third times and passed, and ordered
to be engrossed.
On motion of Mr. Scaweil, ordered, that a message be sent to the
House of Commons, proposing to ballot immediately for Major-general
of tiie nth Division of Militia; and. on motion of Mr. Allen, the name of
William D. Smith was added to the nomination.
Mr. Minion presented the following preamble and resolution, to wit:
“Whereas it often happen.5, that the widows and infant children of intestates, are left in-
possession of some property, but too inconsiderable in amount to be an inducement to any
person to administer thereon and undertake the settlement of the debtspf such intestines,
