Senate amendments makes the following changes to the 5th edition.
Amendment #2 amends Parts IV and V.
Part IV
Revises the changes proposed to GS 136-44 .2E(c) in Amendment #1. to require the Secretary of Transportation to access and
use funds in the Emergency Reserve in a manner that ensures the funds are eligible for reimbursement or for cost sharing of
federal funds (previously, eligible for federal reimbursement only).
Part V
Adds to Section 5.2. Modifies the limitation on the Department of Transportation (DOT)'s contractual commitments based
on available cash balance by allowing the DOT to make commitments necessary to restore transportation infrastructure
damaged as a result of a natural disaster or other emergency. Requires the Secretary of Transportation to report such a
commitment within 72 hours to the Board of Transportation, the Transportation Oversight Manager at the Office of State
Budget and Management, and the Joint Legislative Transportation Oversight Committee. Sets expiration of this authority
for January 1, 2021.
Amendment #3 amends Part V.
Part V
Adds to the proposed changes to GS 143B-350(b)(l ), concerning changes to the Board of Transportation
(ВОТ),
to delete the
proposed requirement that one member elected by the Executive Committee of the Local Government Commission shall serve
as an ex officio nonvoting member of the Board. Additionally, eliminates proposed member qualifications in proposed
subdivision (b)(5). Makes conforming changes regarding
ВОТ
membership, as amended.
Modifies GS 143B-350(e) regarding the meeting and organization of the
ВОТ
so that the Governor selects the chair for a two-
year term and may select a chair for an additional two-year term (under current law. the
ВОТ
selects the chair).
