H 158 (2017-2018) SPECIAL ASSESSMENTS CRITICAL INFRASTRUCTURE. Filed Feb 21 2017 , AN ACT AUTHORIZING CITIES
AND COUNTIES TO PROVIDE FOR THE PAYMENT OF ALL ORA PORTION OF THE COST OF CRITICAL INFRASTRUCTURE
PROJECTS BY USING FUNDS FROM PRIVATE PARTIES AND REPAYING THE FUNDS BY MAKING SPECIAL ASSESSMENTS ON
BENEFITED PROPERTY AND CLARIFYING THE RECIPIENT OF THE PROCEEDS FROM A PERFORMANCE GUARANTEE.
Senate amendment #1 amends the 3rd edition by adding a new section amending GS 160A-372(g), concerning performance
guarantees. Establishes that no person can claim any rights under or to any performance guarantee provided pursuant to
subsection (g) or in the proceeds of any such performance guarantee other than the following three entities or persons: (1 ) the
local government to whom the perfonnance guarantee is provided; (2) the developer at whose request or for whose benefit the
performance guarantee is given; and (3) the person or entity issuing or providing the perfonnance guarantee at the request of or
for the benefit of the developer. Clarifies that this new section of the act is intended to clarify existing law as it pertains to
perfonnance guarantees issued under GS 160A-372 and GS 153A-331 (sets out the content and requirements of subdivision
control ordinances adopted by cities and counties). Makes confonning changes to the act's title.

HUNTING OF WILD ANIMALS AND UPLAND GAME BIRDS ON SUNDAY AND TO ALLOW HUNTING OF MIGRATORY BIRDS
ON SUNDAY.
Senate committee substitute makes the following changes to the 2nd edition.
Modifies the limitations set forth in GS 103-2, concerning the method of take when hunting on Sunday. Amends subsection (a),
allowing any landowner or member of the landowner's family, or any person with written permission from the landowner, to hunt
wild animals and upland game birds on Sunday, provided that hunting on Sunday within 500 yards of a place of worship in
existence on or before J une 1 . 20 1 7, or any accessory structure thereof, is prohibited (currently, does not specify a date of
existence to which the prohibition applies to places of worship, and also prohibits hunting on Sunday within 500 yards of a
residence not owned by the landowner). Similarly, amends proposed subdivision (al)(2), allowing any person to hunt wild
animals and upland game birds on Sunday on public lands of the State managed for hunting, provided that hunting on Sunday
within 500 yards of a place of worship in existence on or before June 1, 201 7, or any accessory structure thereof, is prohibited
(previously, did not specify a date of existence to which the prohibition applies to places of worship, and also prohibited hunting
on Sunday within 500 yards of a residence). Further, modifies proposed subsection (a2), allowing the hunting of migratory birds
on Sunday if authorized by proclamation or rules of the Wildlife Resources Commission, provided that hunting on Sunday within
500 yards of a place of worship in existence on or before June 1 , 20 1 7. or any accessory structure thereof, is prohibited
(previously, did not specify a date of existence to which the prohibition applies to places of worship, and also prohibited hunting
on Sunday within 500 yards of a residence). Makes organizational changes to subsection (a2).
Adds a new section amending Section 5(c) of SL 20 15- 144. Establishes that Section 5(b) of SL 2015- 144 is effective October 1.

on Sunday as allowed in GS 103-2. and sets out requirements that such an ordinance must meet Makes confonning changes.
