TO AUTHORIZE THE COMMISSION
FOR HEALTH SERVICES TO ADOPT RULES REQUIRING FOOD ESTABLISHMENTS TO POST
INFORMATION ABOUT CERTAIN FOOD ALLERGIES.
Amends GS 130A-248 to require the Commission for Health Services to adopt rules requiring establishments
preparing or serving food containing peanuts or tree nuts to post a notice to consumers explaining peanut and
tree nut allergies and the consequences of exposure of individuals with these allergies to food containing these
items; directs the Department of Health and Human Services, Division of Public Health, to prepare allergy fact
sheets, which will be provided to local boards of health and given to establishments by local health inspectors.
Also requires establishments to include a statement about peanut, tree nut, and shellfish allergies in menus.
Effective October 1, 2007, and provides that the Division of Public Health may adopt temporary rules.
