SEP 19 1996 SENATE BILLS N.C, STATE LIBR/ RALEIGH S 6. 1996 TAX REFORM ACT. Intro. 7/8/96. House committee substitute replaces 2nd edition. Engrosses House amendments #1 adopted 7/25/96 and #3 adopted 7/26/96 with one change: modifies the amendment to GS 1 0S- 267 added by House amendment #3 to fix the protest period for State taxes other than excise taxes as one year after payment (was, 30 days after payment or three years after return due to be filed, whichever later). S 41. NONPARTISAN SUPERIOR CT. ELECTIONS. Intro. 7/15/96. Senate committee substitute, as amended, replaces 1st edition with AN ACT TO PROVIDE FOR PARTISAN ELECTION OF SUPERIOR COURT JUDGES IN THEIR DISTRICTS IN 1996 AND NONPARTISAN ELECTION IN THEIR DISTRICTS THEREAFTER AND CONCERNING VACANCIES IN SUPERIOR COURT JUDGESHIPS. Partisan election within districts. Effective upon ratification and applicable to 1996 elections, adds GS 7A-41.2 to provide that candidates for superior court judge will be both nominated and elected by district (now, statutes provide for nomination by district and statewide election). Makes conforming changes in election laws. This part is effective only if both this part and the next part concerning nonpartisan elections are approved pursuant to Section 5 of the Voting Rights Act of 1965, except that 1994 elections which were conducted under this method pursuant to court order are validated and confirmed. [Substantially identical to H 195, 1996 Regular Session.] Nonpartisan elections. Effective for 1998 elections and thereafter, adds new Art. 25 to GS Ch. 163 to provide for the nonpartisan nomination and election of superior court judges by district. Nonpartisan primary to be held to narrow field of candidates to two candidates for each position to be filled, if there are more than two candidates for a single office or the number of candidates for a group of offices exceeds twice the number of positions to be filled. Those candidates receiving the highest number of votes, equal to twice the number of positions to be filled, shall be declared nominated. Election results determined by plurality. Provides form of notice of candidacy, designates time for filing, and requires filing fee equal to 1 % of the annual salary of office sought. If candidate does before the election, the filing fee may be refunded. In lieu of payment of filing fee. petition signed by 10% of registered voters of election area may be filed.
