H 1304. MODIFY PRISON CAP. "TO MODIFY THE PRISON POPULATION CAP." Amends various
statutory provisions to set prison population cap: (1) effective June 30, 1991, at 98% of 19,646
(now, 98% of 20,435) and requires reduction of population within 90 days to 97% of 19,646 (now,
20,435); (2) effective Feb. 1, 1992, at 98% of 20,394 (now, 19,646) and requires reduction of
population within 90 days to 97% of 20,394 (now, 19,646); and (3) effective May 1, 1992, at 98%
of 20,594 (now, 20,394) and requires reduction of population within 90 days to 97% of 20,594
(now, 20,394). Authorizes Sec’y of Correction to advance or to delay effective dates of act’s provi¬
sions by not more than 45 days, based on availability or lack of prison space. Requires Sec’y to
report on progress of prison construction and capacity in 1991-93 biennium to chairmen of
Senate and House appropriations committees and appropriations committees on justice and
public safety during 1992 session.

Senate committee substitute: (1) amends GS 14-
107 to make worthless check over $2,000 (original bill, over $1,000) a Class J felony; (2) amends
GS 14-107(1) to make punishment provision (maximum 30 days’ imprisonment or $50 fine) apply
to check not over $100 (current law, not over $50); (3) amends GS 14-107(2) to make punishment
provision, which is changed to maximum $250 fine (current law, $500 fine) or six months’ impris¬
onment, apply to check over $100; (4) amends GS 14-107(1) and -107(2) to provide that person
convicted of fourth offense must be ordered, as probation condition, to refrain from maintaining
checking account for three years; (5) amends GS 14-86.1 to authorize forfeiture of conveyance
when it is used in larceny of property whose value is over $2,000 (original bill, over $1,000); and
(6) amends GS 108A-53(a) to make food stamp fraud a felony if amount taken is more than
$2,000 (original bill, over $1,000).
