for ami paid to the faid Truftees and Directors, at the fame Time, in the fame Man¬
ner, and under the like Penalties, as by Lav/ is directed for collecting, accounting
lor, and paying Public Taxes.
IV. AND whereas by an Act of Aliembly palled at Nevibern, in the Year of
our Lord One Thoufand Seven Hundred and Fifty Eight, for applying e'ertain
Monies, to be collected on the Tonnage of Veffeis, to enable the Commiffioners of
Port Roanoke to amend tiie Navigation of the faid Port, and for other Purpofes •,
and whereas the faid Monies never have been, or is there any Probability that the
fame ever will be applied for the Purpoies aiorefaid, but ftill remain in the Hands
of the Commiffioners, or the Receiver of the laid Duty : Re it therefore Enacted , by
the /hilarity aforefaid , That the laid Commiffioners, and the faid Receiver, (hall,
immediately trem ant! after the paffing of this Act, pay to the Truftees and Direc¬
tors for building the laid Courc- Houle and Prilon, all fuch Sum and Sums of Mo¬
ney as Avail remain in their I Ian. s not applied agreeable to the Act of Affirm Lily
aforefaid •, and t<> be replaced ami refunded at luch Time, and in (uch Manner, as
the Governor, Council, and Afi'cmbly, fnall think proper.
V. A NF> be it further Ena fed, by the Authority aforefaid, That from and after
the paffing of this Ac, tii laid 1 ruftees and Directors are hereby required and
impowered

Houfe, Prifon, and other Public Buildings, that are now Handing on the Public
Lots in the Town ot Edentcn.
VI. AND be it further Enabled, by the Authority aforefaid, That the faid Truf¬
tees and Directors fhall apply all iuch Monies as (hall come to their Hands in Vir¬
tue of this Act, ami lucii other Sum or Sums ol Money a they fhall obtain by the
voluntary Donations oi Gentlemen and others, towards building and erecting the
faid Court-1 Joule and Prifon, in luch Manner as to the laid Truftees and Directors
fhall leem molt convenient.
VII. AND be it further Enacted, by the Authority aforefaid, That before the
faid Truftees and Directors fhall enter upon their laid Truft, or take into their
Hands any of the Monies aforefaid, they lhall enter into Bond, in the Sum of Two
Thoufand Pounds, payable to his Excellency the Governor, and to his Succeffiprs,
with Condition lor the faithful Dilcharge of the feveral Trulls in them repofed by
this Act ; and that they will, from Time to Time, and at all Times when they fhall
be called upon, lay a juft State of their Tran factions before the Affembly, or luch
Committee as (hall be appointed to fettle and adjuft the Public Accounts ; which
Bond lhall be lodged with the Clerk of the Superior Court for the Diftricc of
Edentcn.
VIII. AND beit Enacted, by the Authority aforefaid, That if the Taxes, or
other Monies arifing in Virtue of this Act, lhall be more than fufficient to compleat
the Buildings herein directed, the Surplus thereof Ural!, by the Truftees herein
named, be paid to the Courc of each County, in Proportion

Taxables collected from each of the faid Counties, and paid by the Sheriff to the
Truftees.
