An Act to repeal an Act paffcd at W ilmington, in the Tear of our Lord One Thoufand
Seven Hundred and Forty One, intituled , An Act to edablilh Ports, or Places of
Delivery of Merchandizes, imported in, and exported out of this Province, and
to prevent the clandeftine running of uncuftomed Goods in the fevcral Ports
thereof.
I. TT 7 HERE AS it is found very inconvenient and injurious to Traders and

V V efiels arriving at the fcveral Ports and Places in the faid Aft mentioned,
and there being obliged to unlade and continue, whereby great Damages, Lodes,
and Delays, have accrued, and much of the Trade of this Province, which hereto¬
fore tiled to be carried on by Water, has of late been diverted, anti carried on by
Land to Virginia .- For Remedy whereof,
as rcpeiied. II. WE pray that it maybe Enadlcd, And be it Enabled, by his Excellency
Gabriel Johnflon, Efq-, Governor, by and -with the Advice and Confent of his Majejly’s
Council and General Affembly of this Province, and it is hereby Enabled by the Authority
of the fame, That the faid Aft be and is hereby repealed, to all Intents and Pur-
pofes, as if the fame had never been made.
Not to extend to III.

Reafon to fear that lucli Parts of this Province which are fituated molt
commodious for Shipping to enter, may be invaded by the Enemy; and whereas
the Entrance of Cape Fear River, from its known Depth of Water, and other Con¬
veniences for Navigation, may tempt them to fucli an Enterprize, while it remains
in fo naked and deiencelefs a Condition as it now is : Therefore, for the. better

II. W F, pray that it may be Enafted, And be it Enacted, by his Excellency Ga¬
briel Johnflon, Efq-, Governor, by and with the Advice and Confent of his Majcflf s
Council, and General Affembly of this Province, and it is hereby Enacted, by the Au¬
thority of the fame, That his Excellency Gabriel "johnflon, Efq; Governor, the Kon.
Nathaniel Rice, Robert Hallon , Elcazer Allen, Matthew Rowan, Edward Mcfe'ey,
Reger Moore , William Forbes, Efqrs. and Colonel James limes, William Paris, Efq;
Major John Swann, and George Moore, Efq; be, and arc hereby appointed Commil-
fioners ; who, or the Majority of them, 111 ail have full Power and Authority to crcft
and build a Fort or Battery, in fuch Place on the lower Parts of Cape Fear River,
as to the Majority of them (ball feem mod convenient, for the Defence of the faid
River: Which Fort or Battery fliall be called Johnflon’ s Fort, and (ball be large
enough to contain, at lead, Twenty Four Cannon, with Barracks, and other Con¬
veniences, for Soldiers. III. A N D
