were attached to answer unto Thomas Peterson Esquire
factor to Thomas Byfield of New Pennsylvania Company
merchant In a plea of tresspass upon ye case
And whereupon is said Thomas Peterson in his aforesaid capacity by
Edward Baliwick his Atturny complains that whereas ye said Thomas
Byfield and Company by thare factor The said Thomas Peterson at Passco
:tank the 22nd day of August 1709 at the special Instance & Request of .
the sd Emanuell Low and William Vaughan In Company, had sold unto ye
sd Emanuell Low and William Vaughan In Company the Hull of ye sloop.
Roanoke Merchant being cast on shore on Cow Island, which sd Hull
After the said 22nd day of August by virtue of the sd sale, they ye sd Emanuell
Low and William Vaughan In Company did take into thare possession, as
thare own proper Hull, In Consideracon whereof the sd Emanuell Low
and William Vaughan In Company. Upon themselves asumed & unto the sd
Thomas Peterson faithfully promised, that they the sd Emanuell Low
& William Vaughan in Company When thereunto afterward Required
Would pay Unto the sd Thomas Peterson the Sum of ninety pounds
in the severall species mencond In an account to this decls annexed
& here into Court brought , Ans also at ye Like In France & Request
of ye sd Emanuell Low & William Vaughan In Company at Pascotank
afore sd the 24th day of august In ye year aforesd had Sold & Deliverd
unto ye sd Emanuell Low and William Vaughan in Company Cables, Anchors
Riggin, & other things, weighing two thousand seven hundred and twenty
six pounds at ye Rate of three pounds per hundred weights which amounts
to ye sum of Eighty one pounds fifteen shillings and six pence, & also
Certain sayles at the price of twelve pounds four shillings and six pence
Which sd sums of £82.15.6 and (pound symbol) £12.4.6 amounts to ye sum of
ninety four pounds current money of this province as by an account to
this Decls annexed here Into Court brought the same appears, In
Consideracon whereof the sd Emanuell Low and William Vaughan In
Company upon themselves apeared & unto ye sd Thomas Peterson
then and there faithfully promised that they ye sd Emanuell Low and
William Vaughan in Company the aforesd sum of (pound symbol) £94.0.0. When thare
unto afterward Required, unto ye sd Thomas Peterson, would well and
truly Content & pay, Yet never the less ye sd Emanuell Low and William
Vaughan in Company now Either of them, their aforesd promises, and
Assumptions not minding or Regarding, but plotting Contriveing &
fraudulently intending him the sd Thomas Peterson in that behalfe
craftily & subtily to deceive & defraud ye aforesd sum of £90-0-0 in
the [suirath?] species specified in ye first mencond account nor ye sum
of £94-0-0 specifyed in ye second mencond account Unto ye said
Thomas Peterson according to their sd promise & assumptions
altho offten Required & have not paid, but the Same to pay have &
still do deny & Refuse & unjustly detain to ye Damage of Thomas
Peterson in his aforesd Capacity one hundred & Eighty pounds In
the species specifyed in the first mencond account & ye sum of one
hundred and eighty eight pounds of current money of this province for
specified in ye second account and thereupon produceth this Suit
