and upon conviction before any couri having jurisdiction, shall
be fined and impii-oncd at the discretion of the com l; and any
ch'rgvmoi, minister ol the Gospel or justice of t lie peace, who
shall knowingly marry any free negro or free person of colour to
a white person, shall be guilty of a misdemeanor, and upon mn-
victmn in any court havingjutisdieiioi), shall be lined and impri¬
soned at the discretion of the court.
III. Beil further enacted. That hereafter it shall not be lawful
for any fire negro or free person of colour to intermarry or coha¬
bit and live together as man and wife with any slave; and any
free negro or person of colour so intermarrying or cohabiting and
living as man and wife will» a slave, shall be liable to indic'ment,
and upon conviction shall be tim'd and imprisoned or whip’, at
the discretion of the court; the whipping not to exceed thiity-
nine lashes: Provided , that this section shall cot extend to any
case where an intermarriage or cohabiting or living together took
place before the passing uf this act.

CHAPTER V
An act to prevent the circulation of seditious publications, and for oilier purposes.
Be it enacted by the General .Assembly nj the State of jXorth
Carolina, and it is hereby enacted by the authority of the same.
That if any person shall knowingly bring into this Slate, with an
intent to circulate, or knowingly circulate or publish within this
State, or shall aid or abet the bringing into this State, or the cir¬
culation or publication within the Stale, any written or printed
pamphlet or paper, whether written or printed in or out of the
State, the evident tendency whereot would be to excite insurrec¬
tion, conspiracy or resistance in the slaves or free negroes ant!
persons of colour within the State, or which shall advise or per¬
suade slaves or free persons of colour to insurrection, conspiracy
or resistance, such person so offending shall be deemed guilty of
felony, and on conviction thereof in any court having jurisdiction
thereof, shall for the first offence be imprisoned not less than one
year anil be putin the pillory and whipped, at the discretion of
the court; ami for the second offence shall suffer death without
benefit of clergy.
II. Be it further enacted, That if any person shall by words
