CHAPTER 110.
AN ACT TO PERMIT DEFENDANTS IN CRIMINAL CASES TO TESTIFY
IN THEIR OWN BEHALF.
The General Assembly of North Carolina do enact :
Section 1. That chapter forty-three, section sixteen,
Battle’s Revisal, be amended by striking out the words
“competent or compellable to give evidence for or against
himself or shall render any person.”
Sec. 2. That in the trial of all indictments, complaints
or other proceedings against persons charged with the
commission of crimes, offenses and misdemeanors in the
superior, inferior, criminal and justices of the peace courts
of this state, the person so charged shall at his own re¬
quest, but not otherwise, be a competent witness, and
his failure to make such request shall not create any
presumption against him.

3. That on the trial of all criminal actions, the
wife of the defendant shall be a competent witness for
defendant.
Sec. 4. That all acts or parts of acts in conflict with
this act be and the same are hereby repealed.
