SENATE BILLS
S 35. 1995 WELFARE REFORM. Intro.
1/26/95.
Senate committee substitute replaces 1st edition. Changes title to
"AN ACT TO ESTABLISH THE 1995 NORTH CAROLINA PARTNERSHIP FOR INDEPENDENCE ACT' and
substantially rewrites original bill. Adds new GS 108A, Article 2, Part 1A. Sets forth overall goal of welfare reform
at GS 108A-26.10. Establishes "Work First Program" at GS 108A-26.11, which provides that Dep't of Human
Resources shall ensure that all AFDC assistance is focused on enabling all recipients to work or to be assisted in
preparing to work, unless exempt. Replaces JOBS program with Work First Program. Provides for diversion
assistance for eligible AFDC recipients. Requires all recipients of AFDC assistance to sign personal responsibility
agreements and specifies components of agreements. Requires all minors under agreement to obtain high school
education or equivalent, and that all recipients with school-age children keep them in school as required by the
Compulsory Attendance Law. Establishes education and training component of Work First Program, which may
be compensated or uncompensated, and which generally requires 30 hours of work or training each week.
Encourages recipients of food stamps to participate in performing uncompensated public and private work. Sets
forth exemptions from program, including recipients under age 16, those ill or disabled, those over age 60, those
who are needed in the home to care for ill or disabled, those who would be required to travel more than two hours
round trip for a normal work/training day, or those who are relatives caring for children under kindergarten age.
Sets forth sanctions to enforce provisions, including fines of $25 and suspension of benefits. Provides that AFDC
benefits for minor unmarried specified recipients who are parents shall not be available to those who are not living
with their parents or guardians, unless there is reasonable concern that abuse to them or their children will result.
Bars Dep't from increasing assistance to recipients who have more children born at least 10 months after they
begin receiving assistance, except in cases where birth results from rape or incest. Limits overall benefits to two
cumulative years, including education and Work First Work/Training. Bars assistance to felons, parole, or
probation violators. Requires drug and alcohol treatment and drug testing for welfare recipients. Sets forth
procedure for paternity establishment. Includes original bill provisions on removal of work disincentives, additional
work incentives, fraud prevention initiatives, simplification, NC. CAN, electronics benefits transfer, state
government participation in welfare reform, and Part 1A controls.
S 320. UNIFORM CUSTODIAL TRUST ACT. Intro.

House committee substitute replaces 2nd edition.
Adds new GS 33B-17(d) to provide that instrument described in that section must also be signed by at least two
witnesses, neither of whom is custodial trustee or the distributee of the custodial trust property. Failure to comply
with witness or acknowledgment requirement shall not affect validity of trust during life of beneficiary, but shall
invalidate only direction or designation of the distributee on termination of custodial trust. Eliminates GS 33B-22
provision which limited contributions of custodial trust property to corpus to no more than $100,000.
