H 121. REGULATION OF GOLF CARTS IN RIVER BEND. Filed

TO ADD THE TOWN OF RIVER BEND
TO THE TOWNS THAT MA Y REGULATE GOLF CARTS.
Amends GS 160A-300.5 by adding the town of River Bend to those local governments that may, by
ordinance, (1 ) regulate the operation of golf carts on any public street or highway within the city limits, or on any
property owned or leased by the city and (2) require the registration of golf carts, charge a registration fee, specify
who is authorized to operate golf carts, and specify the required equipment, load limits, and the hours and
methods of operation of golf carts.

H 123. DEATH PENALTY/PROPORTIONALITY REVIEW. Filed

TO PROVIDE THAT THE SUPREME
COURT IN CONDUCTING THE PROPORTIONALITY REVIEW REQUIRED BYLAW SHALL CONSIDER NOT
ONLY THOSE CAPITAL CASES IN WHICH THE DEATH PENALTY WAS IMPOSED BUT ALSO FACTUALLY
SIMILAR CASES IN WHICH THE SENTENCE OF LIFE IMPRISONMENT WAS IMPOSED.
Amends GS 15A -2000(d) as the title indicates. Directs that the reported life imprisonment cases compared
by the Supreme Court be limited to those in which the jury recommended life imprisonment on or after the
effective date of this proposed act.
Provides that this act is effective when it becomes law and applies to all capital cases not yet decided by the
Supreme Court on direct appeal.

H 124. JUDICIAL DISCRETION/INDIGENT COUNSEL FEES. Filed

TO ALLOW FOR JUDICIAL
DISCRETION IN DETERMINING APPROPRIATE FEES FOR INDIGENT DEFENSE COUNSEL.
Amends GS 7A-458 to require that the rules adopted by the Office of Indigent Defense Services, which set
attorneys’ fees for indigent defense, include a review process to allow the trial judge to approve a fee amount
based on extraordinary circumstances that exceeds the standard rates established by the rules. Effective October
1, 2009.
