House Bill 806,
“Refrigeration Contractors Amendment”
The following legislation, House Bill 806, “Refrigeration Contractors Amendment” has passed the NC House of
Representatives and been sent to the Senate Commerce Committee for consideration:
A BILL TO BE ENTITLED
AN ACT TO CLARIFY THE DEFINITION OF REFRIGERATION TRADE OR BUSINESS UNDER THE LAWS
RELATING TO REFRIGERATION CONTRACTORS.
The General Assembly of North Carolina enacts:
SECTION 1. GS. 87-58(a) reads of rewritten:
"§ 87-58. Definitions; contractors licensed by Board; examinations.
(a) As applied in this Article, "refrigeration trade or business” is defined to include all persons, firms or corporations
engaged in the installation, maintenance, servicing and repairing of refrigerating machinery, equipment, de¬
vices and components relating thereto and within limits as set forth in the codes, laws and regulations gov¬
erning refrigeration installation, maintenance, service and repairs w ithin the State of North Carolina or any
of its political subdivisions. This Article shall not apply to the replacement of lamps and fuses and to the
installation and servicing of domestic household refrigerators and freezers or domestic ice-making appli¬
ances connected by means of attachment plug-in devices to suitable receptacles which have been perma¬
nently installed. The provisions of this Article shall not repeal any wording, phrase, or paragraph as set
forth in Article 2 of Chapter 87 of the General Statutes. This Article shall not apply to employees of per¬
sons, firms or corporations or persons, firms, or corporations, not engaged in refrigeration contracting as
herein defined, that install, maintain and service their own refrigerating machinery, equipment and devices.
The provisions of this Article shall not apply to any person, firm or corporation engaged in the business of
selling, repairing and installing any comfort cooling devices or systems air conditioning units, devices, or
systems for the purpose of cooling offices, buildings, houses, works, manufacturing plants, or any machin¬
ery, manufactured article, or processing of material.”
SECTION 2. G.S. 87-58 is amended by adding a new subsection to read:
“(al) This Article shall not apply to the repair or replacement of parts or components of a refrigeration
system provided that the repair or replacement of the part or component is performed by any person, firm,
or corporation licensed under G.S. 87-21(a) (1) or (a)(3) or G.S. 87-43.3 and the repair or replacement of the
part or component would be specifically allowed under the applicable law.”
SECTION 3. This act is effective when it becomes law.
The new language in the bill is underlined and any deleted language is marked out. G.S. 87-2 1(a)(1) refers to plumbing
and G.S. 87-21 (a)(3) refers to Heating, Group No. 2 as governed by the State Board of Plumbing, Heating and Fire
Sprinkler Contractors. G.S. 87-43.3 refers to electrical contracting as governed by the State Board of Examiners of
Electrical Contractors.
In summary, this pending legislation would allow electricians, plumbers and air conditioning technicians employed by
firms, persons or corporations licensed under G.S. 87-21(a)(l), G.S. 87-21(a)(3) and G.S. 87-433 (but not licensed by the
