H 1571. DOT FUNDING TO MAINTAIN ROADS/FIVE FAMILIES. Filed
5/4/09.
TO PROVIDE FUNDING FOR
THE DEPARTMENT OF TRANSPORTATION TO ANY PRIVATE ROAD UPON WHICH FIVE OR MORE
FAMILIES LIVE TO PROVIDE ACCESS FOR SCHOOL BUSES AND EMERGENCY VEHICLES.
Requires that $25 million of the funds appropriated to the Department of Transportation for 2009-10 and
2010-1 1 be used to maintain any private road on which at least five families live, leading to a state maintained
public road on which children are transported by school buses, sufficient to accommodate the buses and
emergency vehicles. Effective July 1, 2009.

H 1572. STRIKE FAIL TO APPEAR/BOND PROCESSING FEE. Filed

TO ASSESS A PROCESSING
FEE WHEN A FAILURE TO APPEAR IS STRICKEN AND AS A RESULT A BAIL BOND FORFEITURE IS SET
ASIDE.
Amends GS 15A -544.5(c) to require the court to assess a $50.00 processing fee on any defendant for whom
the court sets aside a bail bond forfeiture after striking a failure to appear. Requires the fee, which must be
remitted to the State Treasurer for use in support of the courts, to be assessed upon the defendant’s conviction,
unless the bail bond in question was executed by a professional bondsman or bail agent or the defendant is
indigent. Makes a conforming change to the fee provisions of GS 7A-304(c). Effective December 1 , 2009 and
applicable to bail bonds set aside for failure to appear on or after that date.

H 1573. HELP HOMELESS VETERANS RECEIVE BENEFITS. Filed

TO FACILITATE THE
IDENTIFICATION OF VETERANS , HOMELESS VETERANS IN PARTICULAR, IN ORDER TO ASSIST SUCH
PERSONS IN OBTAINING BENEFITS TO WHICH THE MAYBE ENTITLED.
Enacts new GS 148-12.1, GS 15A-1 343.4, and GS 122C-210.3 as the title indicates.
GS 148-12.1. Directs the Secretary of Correction to adopt rules requiring that the following inquiries be made
of each prisoner received in the state prison system: (1) has the prisoner ever served in the active or reserve
components of the Army, Marine Corps, Navy, Air Force, Air Guard, National Guard, Coast Guard, or Merchant
Marine and (2) does the prisoner consent to this information being shared with other state, local, and federal
agencies and entered into the Carolina Homeless Information Network (CHIN) database where applicable. Directs
the Department of Correction to enter into an agency participation agreement with the NC Housing Coalition, Inc.
regarding access and use of the CHIN Homeless Management Information System. Provides that the
requirements of this section be interpreted consistent with federal law and that the information obtained under this
section is not a public record under GS Chapter 132.
