H 73. REGULATION OF GOLF CARTS IN MARVIN. Filed
2/5/09.
TO ADD THE VILLAGE OF MARVIN TO THE
TOWNS THAT MAY REGULATE GOLF CARTS.
Notwithstanding GS 20-50 (Owner to secure registration and certificate of title; temporary registration
markers) and GS 20-54 (Authority for refusing registration or certificate of title), provides that the Village of Marvin
may regulate, by ordinance, the operation of golf carts on any public street or highway within the city limits, or on
any property owned or leased by the city. Allows for registration of golf carts, fees for registration, specification of
who may operate golf carts and required equipment, load limits, and hours and methods of operations. Prohibits
the operation of golf carts on any street or highway with a posted speed limit above 35 miles per hour.

H 74. SPEND 65% OF SCHOOL FUNDS IN CLASSROOM. Filed

TO ENSURE THAT AT LEAST SIXTY-
FIVE PERCENT OF SCHOOL FUNDING IS USED FOR CLASSROOM INSTRUCTION
Enacts new GS 115C-408.1 conferring a duty upon the State Board of Education (SBE) to ensure that 65%
of state funds provided for the operations of the public schools are used for classroom instruction. Directs the
SBE to adopt rules to implement the proposed section. Effective when it becomes law and applies to expenditures
for school years beginning with the 2011-12 school year.

H 75. SALARY FUNDS/SPEND ONLY FOR SALARI ES. Filed

TO PROVIDE THAT FUNDS BUDGETED
FOR SALARIES AND WAGES SHALL ONL Y BE EXPENDED FOR THOSE ITEMS.
Amends GS 143C-6-9 to require that funds appropriated for salaries and wages only be used for salary and
wages, employer’s Social Security, retirement, and hospitalization payments. Specifies that, at the end of each
month, lapsed salary savings must revert to the proper unappropriated fund balance (was, may be expended only
for nonrecurring purposes or line items). Makes a conforming change to the caption. Effective July 1 , 2009.

H 76. SCHOOL BOARD CANDIDATE FILING FEE. Filed
2/5/09.
TO SETA UNIFORM FILING FEE FOR
BOARD OF EDUCATION CANDIDACY.
Amends GS 163- 294.2(e) (Notice of candidacy and filing fee in nonpartisan municipal elections), GS 163-
291(3) (Partisan primaries and elections), and GS 163-1 07(a) (Filing fees required of candidates in primary;
refunds) to provide for a $100 filing fee for boards of education candidates. Effective for elections conducted on or
after September 1, 2009.
