H 97. ACTIVE DUTY HUNTING/FISHING LICENSE EXEMPTION. Filed
2/10/09.
TO PROVIDE THAT
RESIDENTS OF THIS STATE WHO ARE SERVING ON FULL-TIME ACTIVE MILITARY DUTY OUTSIDE THIS
STATE IN THE ARMED FORCES OF THE UNITED STATES OR A RESERVE COMPONENT OF THE ARMED
FORCES OF THE UNITED STATES MAY HUNT OR FISH WHILE ON LEAVE IN THIS STATE WITHOUT
OBTAINING A LICENSE.
Enacts a new GS 1 13-276(12) to exempt a member of the US Armed Forces or a full-time active duty
member of a reserve component of the US Armed Forces who is a resident of the state but is serving outside the
state from the hunting and fishing requirements set forth in GS 11 3-270.1

trap); GS 11 3-270. 3(b)(1), (b)(3), and (b)(5) (Special activity licenses; big game kill reports); GS 113-272 (Special
trout license; mountain heritage trout waters 3-day fishing license); GS 113-271 (Flook and line licenses in inland
and joint fishing waters); GS 1 13- 272. 2(c)(1) (Special device licenses); and GS 1 13-174.2 (Coastal Recreation
Fishing License) while on leave in the state for 30 days or less. Requires the member to carry a military
identification card and a copy of the official document issued by the person’s unit confirming authorized leave at
all times during the fishing or hunting activity. Provides that an exempt person is responsible for complying with
the reporting requirements of the Wildlife Resources Commission rules, complying with hunter safety
requirements in GS 1 13-270.1 A, purchasing any federal migratory waterfowl stamps as a result of hunting activity,
and complying with any other state license requirements. Effective July 1, 2009.

H 98. LICENSE RENEWAL/DEPLOYING RESERVISTS. Filed
2/10/09.
TO AUTHORIZE A MEMBER OF THE
RESERVE COMPONENTS OF THE ARMED FORCES TO RENEW A DRIVERS LICENSE UPON RECEIPT OF
DEPLOYMENT ORDERS AND TO ALLOW A THIRTY- DAY GRACE PERIOD FOR AN EXPIRED LICENSE
UPON RELEASE FROM ACTIVE DUTY.
Enacts a new GS 20-4.01 (33c) to add a definition for the Reserve components of the Armed Forces of the
United States. Amends GS 20-7(f) to authorize the Division of Motor Vehicles to (1) renew a drivers license,
without limitation on the time period before expiration, if the applicant is a member of a reserve component of the
US Armed Forces and provides orders showing deployment on active duty stationed outside the state and (2)
consider an expired license valid for 30 days after the release date of a reserve component member, upon
showing proof of that date, if the license expired while the reserve component member was deployed on active
duty outside the state, unless the license was rescinded, revoked, or otherwise invalidated under some other
provision of law. Makes a conforming change. Makes technical and conforming changes to GS 20-7(r). Requires
the Revisor of Statutes to change armed forces to Armed Forces throughout GS 20. Effective for all licenses
expiring on or after the date the act becomes law.
