H 1460. MARTIAL ARTS LICENSURE. AN ACT TO LICENSE MARTIAL ARTS SCHOOLS AND
INSTRUCTORS. Creates new GS Ch. 143, Art. 68A as title indicates. Defines terms and creates Martial Arts
Commission. Commission will be composed of five members as follows: (1) one instructor to serve a two-year
term and one master to serve a three-year term appointed by the Pres. Pro Tern., (2) two masters to serve three-
year terms, appointed by the Speaker, and (3) one public member to serve a three-year term, appointed by the
Governor. Provides for qualifications, filling of vacancies, removal, compensation, officers, and meeting times
Defines Commission powers, which include licensing and disciplining. Provides that on or after
1/1/2000
no
person shall teach martial arts or operate a martial arts school in North Carolina unless that person is licensed
Exempts from provision persons who do not represent himself or herself as an instructor and who teach on a
volunteer basis Defines criteria for licensing martial arts instructors, including being of good moral and ethical
character, completing 468 hours of martial arts courses, completing a basic first aid course, and successfully
completing an examination. Provides for licensing of martial arts schools, Sets maximum fee structure, which
includes a $100 maximum for instructor license and $100 for martial arts school license Provides license
guidelines, including a provision that licenses expire after four years. Authorizes Commission to impose fines,
deny or refuse to renew a license, and suspend or revoke a license under listed conditions, including giving false
information, having been convicted, pled guilty or no contest to a crime that indicates the person is unfit or
incompetent to teach martial arts or operate a martial arts school. Authorizes Commission to apply to the superior
court for an order enjoining violations of this Article Provides that a person who does not have a license who
either claims to be a martial arts instructor or an operator of a martial arts school in violation of the Article is guilty
of a Class 1 misdemeanor.
