NOTES OF INTEREST
"Union Street" in 1882 was known as "North and South
Main Street. "
"North Depot Street" should be East Depot Street. (Also
known as Log Street).
Today 's "Grove A venue" was known as "Fisher's A /ley. "
The "Episcopal Church" on the map was originally the
"Presbyterian Church. "
The "lane" leading to the home of George Washington Brown
is today's "Washington Lane."
"Union School of Concord" on the 11Ulp is the site of today~
"Clara Harris School. " The area for several hundred feet back of
the school was known as "Grover's Field."
The Mason Temple, off Brumley Avenue, is on the
approximate location of the "Gold Mine" and "Fish Pond"
shown on the map.
The "A. Bost" property on Eas.t Depot Street, as shown on the
11Ulp, is today 's site of the Concord Telephone Company.

CHAIN OF TITLE FOR THE FIRST TWO COURTHOUSES
The first courthouse was located on land not surveyed for
a town lot , at the intersection of Union and Corbin Streets,
included in Book 2 , page 60 , from Samuel Huie to John Means,
et al , Commissioners of Public Buildings of Cabarrus County ,
February 4 , 1796 , being 26 acres for the town of Concord.
Sources agree that the second courthouse was located on
Lot No. 1 Northwest, and the existing chain of title proceeds
from the above deed as follows :

April 18 , 1796.
Book 6 , page 174 , from Samuel Huie to John K. Carson and
Hugh Carson, May 4 , 1807 .
There is no further record of John K. Carson's interest .

an undivided half interest , March 1, 1816 .
Book 10, page 15, Thomas Garretson and James Perkins to

George Kluttz ' s will of 1840 , as recorded in the ·
Minute Docket of the Court of Pleas and Quarter Sessions ,
Volume 3 , pages 103 - 104, grants his property, identified as
Lots 1 and 2 Northeast , which was his dwelling house , to his
wife Rosannah for life or until remarriage , then to be sold
with the proceeds to his grandchildren. As there is no
record of Kluttz otherwise disposing of Lot 3 or owning
Lot 1 , this likely does refer to Lots 2 and 3 Northeast .
The property likely remained with Rosannah Kluttz
until about 1870 , when her will is recorded , and on May 30 ,
1876 , the lands of George Kluttz were divided between R . W.
Foard , Martha S . Scott, J. N. Brown , Mary R . Archibald ,
Emma Fetyer , and Chalmer , Catharine , Augusta and June (?)
White, in Book 27 , page 171 .
In the minutes of the County Commissioners for 1877
and 1878, payments are made to certain parties for the land
for the courthouse . On June 4 , 1877 , a note for $1 , 000 . 00
at 8% plus $81 . 50 in cash is paid to J. N. Brown (Book 1 ,
page 376) . On January 7 , 1878 , Brown was paid $300 . 00 on
his note , and $317 . 62 went to the heirs of Josephine White ,
deceased. (Book 1 , page 397) . A note for $4 ,000 . 00 at 8%
went to Martha L . Scott as her due . (Book 1 , Page 398) .
While other heirs are not paid , the minutes are poorly
kept in this period as regards recording of payments . What
evidence there is implies that the Courthouse was s i ted on
good faith , payment being made after the estate was settled .

According to Mr. R. W. Allis on, "The Court House,
a more stat ely building, (than the goal), an d not
very elegant at that, was placed in the center of the
public square, in the crossing of Union and Cor b an
Streets, was 30 x 30 feet, 15 feet hi gh, a frame bui lding,
on pillars 3 feet high, a hip roof covered with
shingles, small windows , two on each side, and t wo
back of the judge's bench, one door on the northwest
side with a windo w on each side of the door, a high
platform for Judge or Magistrate to hold court, a bar
in front with table for clerk and two seats on each
s ide of bar for jury. Very little s tanding room for
citizens or spectators, no place to heat in winter, hot
in summer, cold i n winter."

The fi rst court house was used until a · new one
was built on the northw est corner of Union and Corban
Streets in 1826. The building was of brick, much
larger and more comfortable, with court room, jury
room and a room for the sheriff on the second floor.
On the first floor were four rooms (offices), one each
1826 - 1875 No. Three 1875 - 197?
for the Clerk of the County, Clerk of the Superior
Court, County Register of Deeds and Grand Jury.
Quoting Mr. Alli son: "The court room was very much
cramped and not comfortable or convenient for a
large crowd. This building was b egu n anp fini shed
in 1826 and the firs~ court was held in May, 1826.
John Phifer was one of the building committee appointed
by the County Court. J acob Stirewalt of
t his county and Samuel Lemly of Salisbury were the
contractors ; these gentlemen stood at the head of
their profession as builders. This building was enlarged
and improved in the year 1872 and was destroyed
by fire in F ebruary, 1875. It was insured for
$3 000.00. The County Commi ssioners b ought a lot
a~d had the present courthouse built, b eg in ning construction
in 1875."

The First County Court of Pleas and Qu arter Sessions
was held at the home of Robert Russell, on the
Salisbury Road, on the third Monday , (21st) of January,
1793, in the seventeenth year of our Independence.
The court elected the first sheriff of our then
infant county, Archibald Houston, Jr . , and, on the
following day, J anuary 22nd , elected J ohn Sim ianer,
clerk for the county of Cabarrus.

Dear V~s. Beaver:
Since wri~ing to you yesterday I have had opportunity to see a
photo of the Cabarrus courthouse, which gives me a stronger feeling
for preserving it. It is a dignified and stately example of an
architectural type which is now becoming increasingly rare . Some
day in the not too distant future buildings of this sort, with the
~~pressive tower of your courthouse, are going to be much more highly
regarded than now • . A community lucky enough to have such a landmark
will then prize it and preserve it. ..
Not too long ago the fine old New England churches, which are now so
highly regarded, were maligned as bad architecture and many were
• torn down . In our time there has been a similar derogation of everything
Victorian and hundreds, perhaps thousands, of buildings on the
order of your courthouse have been demolished as bad buildings and
bad architecture. Fortunately now a new appreciation is developing
for this period of our architectural history and many examples are
being rescued.
For example the Gov ernor's Mansion here in Raleigh used to be referred
to as a ''monstrosity . 11 Now all that has changed and the mansion is \.
., being carefully preserved as a gracious architectural specimen and
residence for our governors . In Monroe the courthouse, built in the
1880's, is no longer adequate and there was for some time talk of
tearing it down in order to build a larger and more convenient building
on the site. There was much opposition to this thought and we understand
plans have been developed for building the courthouse elsewhere and
preserving the old building as a historic landmark.

If you can marshal the support for preserving your stately old courthouse,
it is my conviction that future generations will be grateful. If the
building is demolished, Concord and Oabarrus will be losing perhaps its
most important architectural example from the Victorian period.

COURTHOUSE on NATIONAL PRESERVATIOi~ LIST
Our own Cabarrus County Courthouse , built in 1876, is nm-1 included in the Nationa l Register
of Historic Places--an official listing of properties the government deems worthy of
preservation .
COURTHOUSE is described as an important architectural example from the Victorian period.
Our local group hopes to preserve the ORIGil~AL structure , .the four front rooms which were
completed prior to 1900 .
POSSIBILITY of GRANT
There is a possibility that we may qua lify for FE.DERAL GRANT-in-AID on a matching basis as
authorized by the Nationa l Preservation Act of 1966. A LARGE number of members in our
county supporting this project may enable us to obtain money from other sources .

A limited number of prints of the original painting of the Court House by Mel Kester are
still available. Members who pay $25 as sustainers may pick up their print at Historic Cab-arrus
Headquarters , Union Street, North.
NEW PAINTING
Kester,a di stinquished natio~a l ly known local artist , is now at work on a painting of the
Historic McCurdy house, log structure, said to be the oldest house now standing in Cabarrus .
This house is also on the Nationa l Register of Historic Structures. Prints wi l l availabl e

Together , we have come a long way in preserving and restoring our 1876 Courthouse .
We have been through the valleys of doubt and despair an d through faith we have
worked slowly but surely toward the mountain top experience of completing th i s
venture of faith .
We have completed this stage of our preservation and restoration to the base of
the bell and clock tower and all we lack is ·to reach the top of the moun tain , so to
speak , and co mplete the tower and the clock faces .
Counting the bills we have now to pay , an d with the estimated cost of completion
we need $10,000 to get the job don e.

slides showing the Cour t House Survey now underway .

Progress Report on the Preservation and Restoration of the Old Court House.
Thank you fo~ your encourageme~ t , continued interest and f inanci al support. Without
this support , it would not have been possible to come this far. We are presently
working out a long-term lease with the Board of County Commissioners .
The rear of the old Court House has been closed up f rom the aftermath of tearing
away the jail. A11 m·issing outside windows and doors have bee11 replaced so that the
building can be securely locked.
Historic Cabarrus has set up its headquarters office in the first room on the left
of front hall. Even in the midst of repairs, painting and cleaning , a small group
of faithful volunteers has kept the office open several hours f i ve days each week
to receive visitors and give information.
Four organizations in additio11 to His toric Cabarrus have expressed interest in
occupancy with the understanding that monthly expenses must be sha red. These are :
the Old Courthouse Theatre , the Junior Char-ity League , Memorial Museum , and the
Art Guild,
The plumbing downstairs is work~n g and halls and rest rooms have been painted.
Most of the vi nes ~tJhich were damaging the old hand-made bricks have been removed .
Thanks to Howard E1ectric Compa~y lights and receptacles are funct ioning agai n.
Thanks to Allen McDonald the century old clock is keeping perfect time and striking
on the hour and half ho ur. The attic and bell tower are clean and the beautiful
old bell gleams, t~anks to many hours of good work by volunteer boy scouts .
Our organization has no paid employees. All money spent ~s been for direct labor
and materia 1 s . Every effort is being made to get the most for do 11 ars spent. We
are trying to manage your money, as we use our own personal money, as economi cally
as possible .
Contributions and pl edges to Historic Cabarrus Inc . amount to $32,000 toward our
goal of $99 ,000. We have spent $10,000 for the work done so far. The remaining
$22,000 consists of $13,000 in good pledges not yet due and $9,000 cash ($7,000 in
savings and $2,000 in c~ecking account ) . We sti11 need $47 ,000 to meet our goal.
Before proceedjng w~th the rest of the repairs to the outs i de of the building, which
is mainly replac ing wood boxing and cornices and rebui1ding concealed guttering,
then pa i nting the entire bui1ding and tower , we feel we should get mor·e money or
pledges on ha0d. We do not intend to go into deficit financin g.
To those of you have contributed to date, any additional help you can give will be
welcomed .
To those who ha ~ e not yet joined =n this worthwhile and challeng i ng undertaking - do
give it your prompt ~tte0 tion and support. Every person who has an i nterest in the
past and future of Caba rrus County srould have a share in the preservation of this

1. 1 The principal office of the corporation in the State
of North Carolina shall be located in the City of Concord ,
County of Ca barrus . Said offic~ shall . be the registered office
of the corporation , and the corporation shall have and

2 . 4 At all meetings , each adult member ( 18 y ears of age or
older ) in good standing , regardless of class , shall h ave one vote .
Voting b y proxy s hall not be permitted . Ten per cent of the
entire membershi p shall constitute a quor~~ a t any mee ting o f
members , an d the vote of a majority of the members present a t
a meeting at wh±ch a quorum is present shall suffice for the
adop tio n of any matter vote d upon b y the members unles s a greater
proportion is required by l a w .
2 . 5 Membership shall no t entitle any membe r to any i nteres t
o r rights in the assets , property or i ncome of the corporation .
Upon dissolution the assets and property of the corporation shall
be distributed as provided b y the charte r .

2.6 Hembership in the corporation shall not be trans-ferable
and may be terminated by the ·Board of Trustees fo r
non-payment of contributions or other just cause .

BOARD OF TRUSTEES

3.1 The activities , affairs and property of the corporatio~
shall be managed by its Board of Trustees , hereinafter referred

3 .2 Under Article IV of the Articles of Incorporation
the number of the r e gular Board of Trustees shal l be fixed
from time to time by the by-la\¥S . The n umber of trustees
constituting the Board shall be not l e ss than twenty and may
be any number in excess thereof . All trustees shall be merobers
in good standing of the corporation. The initial members of
the Board shall be the five persons named in Article VI of. the
Articles of Incorporation . They shall hold office until the
annual meeting of the members in 1973 and until their succe ssors
are ele cted and q ualified.
3. 3 At the, 1973 annual meeting of the members tHenty
trustees shall be elected for three-year terms . All
trustees shall begin their terms at the meeting at which thay .
are elected and shall _serve until the third annual meeting
following their election or until their suc cessors are e l e cted
and qualified as h e rein provided .

3 .6 Notice of any regul ar or special meeting of the Board

3.9 Any vacancy occurring in the Board of Trustees by reason
of the death , resignation or remova l of a trustee or a n increase
in the number of trustees shall be fi lled b y election b y the Board .
A trustee elected · to fi l l a vacancy shall serve during t he
unexpired term of his predecessor in office .
3.10 No compensation shall be paid to truste~ for their
services as trustees . No remuneration shall be paid to a t rustee
fo r service s performed by him fo r the corporation in any c apacity ,
unless a res olution authori z i n g such remuneration sha ll have been
adopted b y the Board before the services were rendered . A
trustee may no t be a n employee of the corporation .
ARTICLE IV
OFFICERS
4.1 The of ficers of the corporation s hal l be a president ,
one or more vice-pres idents (the numbe r thereof to be determined
b y the Board of Trustees ), a secretary , a treasure r , and such
other officers as may be elected or appointed by the Board , . s uch

4.2 The officers of the corporat ion shall be electe d a t

be trustee s , but all officers must be members of the corporation .

4 . 5 In the absence of the president or in the event of his
inability or refusal to ac t , the vice-president (o r if more than

as from time to time may be assigned to him by the president o r

4.6 The secretary shall keep the minutes of the mee tings
of the members , an d the Board of Trustees, shall see that a ll

by-laws or · as requi red by law , shal l be custodian of the corporate
records and the seal of the corporation and shall affix the
seal on al l appropriate documents , shal l keep a registe r of the
name and address of each mew~e r , trustee and office r , an d in

secretary and such other duties as from time to time may be
assigned to him by the president or by the Board of Trustees .
4 . 7 If required by the Board the treasurer shall give bond
for the faithful discharge of his duties in such sum and with
such sureties as the Board of Trustees shall determine . He shall
have charge and custody of an d be responsible for al l funds an d
securities of the corporation , shal l receive and give rece i~ts
for moneys due and payable to the corporation , shall deposit
al l moneys in the name of the corporation in such banks , trust
companies , or other depositories as shall be selected in
accordance with Article VI of these by-laws , an d in genera l shall

such other duties as from time to time may be assigned to him
by the president or by the Board of Trustees .
4.8 The Board of Trustees may provide for and fix
reasonable compensation to be paid to one or more or all
officers of the corporation for services rendered .
ARTICLE V
COtvi...MITTEES • ·
5.1 ~he Board of Trustees , by resolution adopted by a
majority of the trustees in office , may create a n executive
~ committee of the Board which when the Board is not in session
shall have and may exercise all authority of the Board in the
management of the corporation. Such executive committee shall
consist of the officers a nd three trustees elected by the Board .
The creation of the executive committee and the delegation thereto
of authority shall not operate to relieve the Board of Trustees
nor any individual trustee of any responsibility or liability
imposed upon it or him by law .
5 . 2 Other committees not having and exercising the authority
of the Board of Trustees in the management of the 'corporation may
be d esignated by resolution adopted b y the Board. Unless other-wise
provided in such resolution , members of the corporation who
are not trustees may serve on such committees and the president
shall appoint the members of each committee. Any member of
·a committee may be removed by the president or the Board \·7henever
in their judgment the best interests of the corporation will
be served thereby .

CONTRACTS , DEPOSITS , CHECKS AND FUND S
6 . 1 The Board of Trustees may authorize any officer or
agen t of the corporation , in addition t o the officers s o
authorized by these by-laws , to enter into any contract or execute
and deliver any instrument in the name of and on behalf of the
corporation , and such authority may be general or confined t o
specific instances .
6 . 2 All funds of the corporation shall be d e posited from
time to time to the credit of the corporation i n such banks ,
trus t companies , or other depositories as the Board of Trustees
ma y designate by resolution. All checks , drafts , or orders for

A meeting of the Board of Trustees of Historic Cabarrus, Inc .
was held in Memorial Hall on December 6 , 1973 , with fourtee n
members present .
Minutes read and approved .
Dr . George A. Engstrom gave the Treasurer ' s Report showing
that $6 , 865.30 had been received , that disbursements had been
made in the amount of $1 , 859.09 an d that there was a balance
in the treasury of $5,006.21 . He also reported that there were
outstanding bills in the amount of about $300.00 , and that the
total membership at that time was 250 .
Mrs. Janet Magaldi announced that note paper showing some
of the places of interest in the county was ready for distribution
and would be on sale at several of the stores in Concord within
the near future .
Branson Jones presented Mr . Charles Grier and Mr. Mark
Finton of the firm of Grier and Fripp who discussed in genera l
their impression of the Cabarrus County Courthouse and outlined
some of the things which would be necessary in order to give an
accurate appraisal of the work which would need to be done and
amount of the research which wou ld be necessary to properly
identify it in its restored condition with the period in which
it was constructed.
The matter of the restoration and preservation of the mura l
in Memoria l Hall was discussed and the suggestion was made that
it first be determined whose responsibility it is to see that
the same is accomplished .
Announcement was made of the fact that Mr. Goldman ,
who owns the building in which the old ~estern Union office
was located is available to the corporation for use as a central
downtown office at the price of $100.00 per month . On motion
made by Branson Jones and se c onded by Dr . R . Brown McAllister
it was decided that we should rent this office on a trial basis
for a period of three months .
Other matters of general interest were discussed .

MINUTES OF THE FIRST MEETING OF THE MEMBERS OF
HISTORIC CABARRUS, INC .
The first meeting of the members of Historic Cabarrus, Inc . was
held in the Superior Courtroom in the Cabarrus County Courthouse at
7:30 O'clock P.M., on Monday, the 21st day of May, 1973.
On motion duly made, seconded and unanimously adopted, Mrs.
Janet Magaldi was elected temporary chairman.
Mrs. Magaldi explained the purpose of the meeting and objects
for which the corporation was organized saying that in its broader scope
the principal objects of the corporation are to preserve, restore , secure
and maintain places and things of historic interest in Cabarrus County
and that the building of primary interest for preservation and restoration

is the Cabarrus County Courthouse which was completed and first occupied

in 1876.
Mrs. Magaldi discussed the contacts which she and those who had
worked with her had made with reference to the work which was later to be
assumed by the corporation. She also presented a series of slides showing
.different views of the courthouse and discussed its architecture and the
changes which have been made since it was originally constructed.
Mrs. Elma S . Beaver made a short talk in which she discussed the
preservation and restoration of the co urthouse and other places of interest
in the county.
Several of the members had questions which were discussed.
li In discussing membership in the corpor~tion , Mrs. Magaldi stated

that there are four (4) classes of membership, namel y : student, regular,
sustaining and patron m~tnbers a nd that the annual contrib ution for student
members is $2 . 50 , the regular members $5 . 00 to $25 . 00 , for sustaining
members is $25 . 00 to $100. 00, and for patron members i s $10 0. 0 0 t o
$1,000 . 00 . She a l so stated that until the limited supply is exhausted, upon
payment of their dues , sustaining and patron members will receive a print
showing the courthouse as made from a painting by Mel E . Keste r .
The chairman then announced that the next order of business was the
election of trus tees, whereupon the following were duly elected to serve
for a period of three (3 ) years or until thei r successors were elected and

A meeting of the members of Historic Cabarrus , Inc . was hel d a t
7:30 o'clock p. m. on June 25 , 1973 , in the ballroom of Hotel Concord,
with Dr . Hector H. Henry , II, presiding.
The minutes of the previous meeting of the members were read
and approved.
In his opening remarks the President advised the members that a
committee with Mrs . Janet Magaldi as its chairwoman was working with
local historians and the Department of Archives and History on a brochure
entitled "Cabarrus T r.a il" . This brochure when completed will list a number
of pl aces in Cabarrus County which are of historic importance .
Dr. George Engstrom reported that there were two hundred ten (21 0)
members of the organization.
The featured speaker for the occasion was Mr . Charles Gree r
Suttlemyre, Jr .• who is a staff member of the Office of Archives and History.
State Department of Art. Culture and History, in Raleigh. North Carolina .
Mr. Suttlemyre is recognized as an expert in the field of earl y North Carolina
buildings and historic restorations . He illustrated his talk with slides showing
various buildings in North Carolina and discussed the type of architecture of
each of them pointing out not onl y the general characteristics but discussing
in detail the particular aspects by which each of them can be identified.
In discussing the Cabarrus County Courthouse . Mr. Suttlemyre identified
its architecture as being "Second Empire" which was prevalent in the period
from 187 0 to 1880. He described our courthouse as being the purest example
of thi s type o f architecture in the state .
At the concl usio n of Mr. Suttlemyre ' s remarks a question and answer
period was observed.

A meeting of the Executive Board of Historic Cabarrus , Inc . was
held at 7:30 o'clock p . m . on August 21 , 1973 , at the offices of Dr . Hector
H . Henry, II , at 103 Lake Concord Road , N . E ., Concord, North Carolina.
Present were Dr . Hector H . Henry. II, Mrs . Janet Magaldi, Mrs . Gail
Marshall, Dr. George A . Engstrom, Dr . Joe V. Davis , Jr. , John H .
Foard, Jr. and John Sharpe .Hartsell.
The meeting was called to order by Dr. Henry .
John H . Foard , Jr. presented a brochure of the Wilmington , North
Carolina area and discussed the various methods which were used in that
area for the promotion of civic undertakings.
Mrs . Gail Marshall discussed some suggested methods of advertising
which were under consideration for the promotion of the membership drive
with particular reference to the desirability of billboard advertising . It was
suggested that Mrs . Marshall make further inquiries as to which billboards
will be availabl e , the cost of each and the term for which the.y may be
l eased.
During the discussion of the purposes for which the organization was

established it was agreed that we should emphasize the fact that although
the preservation of the Cabarrus County courthouse is most urgent there
are many other pl aces which should be preserved ~nd restored .
Thereafter at the conclusion of the discussion Dr. Henry announced
that he had been approached by members of his political party to file as a
candidate for membership on the Board of Aldermen of the City of Concord.

He indicated tha"t he had not reached a decision as to what action he woul d take .
He said, however, that if he should decide to seek public 9ffice he felt it
best that he should resign as President of Historic Cabarrus , Inc .

Enclosed you will find some material which I ran across in the
"Miscellaneous Records" of Wake County. Because it was located in
such an unlikely place, it is not at all surprising that David Brown
did not discover it during the course of his research . The material
I am referring to is a set of specifications drawn up by George S. H.
Appleget for th~ iron work on the jailhouse which was being built in
conjunction with the courthouse . David mentions the fact that the
county corrmissioners ordered the construction of both a jail and
courthouse following the fire of February, 1875. He also states that
this jail was replaced in 1913- 1915 when major additions were made to
the courthouse. These specifications apparently describe the county
jail begun in 1875 well to the rear of the courthouse. and across
Church Street--the one which appears on the Gray 1s Map of 1882.
I am able to add only a few additional details . While Appleget
did the iron work on the jail, the general contractor was John Wilkes
of Mecklenburg County. In 1879 it was necessary for Wilkes , trading
as the Mecklenburg Iron Works , to bring suit against Appleget in Wake
County for recovery of $83. 00 , which Appleget had failed to pay for
materials. The verdict was in Wilkes ' s favor, and Appleget was
ordered to pay. This was less than a year before his death .
I thought you and your group would be interested in knowing about
Appleget ' s involvement with the jail. You may want to add his specifications
to the appendixes of David~s report.
