Data Summary 50 The C-1 area of coastal North Carolina lies just south and west of the New River in Onslow County. Review of the bacteriological and shoreline survey data collected during the time period covered within this report indicates that there has been some widespread decline in bacteriological water quality throughout the area, although only one sampling station currently exceeds the standards for Approved status. No changes in classification will be recommended, and the current Conditional Area Management Plan will continue to be used. 1.0 SANITARY SURVEY 1.1 INTRODUCTION The C-1 growing area is composed of all waters between Intracoastal Waterway (ICWW) Channel Marker #4 near Swan Point and ICWW Channel Marker #25 near Alligator Bay, including Chadwick Bay, Fullard Creek, Bumps Creek, Biglings Creek, Hell Gate Creek, Charles Creek, Alligator Bay, Mill Creek, and a portion of the Intracoastal Waterway. Overall, the area includes a total of approximately 3,955 water acres (Figure 1). The communities of Sneads Ferry, Peru, Chadwick Acres, and North Topsail Beach line the shores of the growing area, and according to US Census Block Data from 2010, the permanent population within the C-1 watershed is about 4,226. See Figure 2 for a map of the growing area, including sampling station locations, and see Table 1 for a description of those sampling stations. 1.2 SHORELINE SURVEY OF POLLUTION SOURCES A comprehensive shoreline survey of Area C-1 was completed in August 2015. Evaluations of properties in the area were conducted by NC Shellfish Sanitation staff to determine potential sources of pollution entering shellfish growing waters (Figure 3). The Onslow County Health Department was notified prior to the survey, and agreed to provide corrective action and follow-up for any malfunctioning septic systems or illegal on-site wastewater discharges discovered. Survey Methods New actual and potential pollution sources for this survey were mapped using GPS, and pollution source data were collected using Trimble’s sub-meter GeoXT GPS receiver with EVEREST multipath rejection technology. Data were collected in the SSF format using real-time corrections from the integrated Wide Area Augmentation System receiver. The data were post-processed using GPS Pathfinder Tools applications in order to get the most precise data. Additionally, a Geographic Information System (GIS) was developed, including pertinent information and digital pictures for each source. Non-Point Source Pollution Marinas – Marinas and dockage facilities are evaluated during the shoreline survey because of their potential to affect the suitability of adjacent shellfish waters for harvest through inputs of both biological and chemical contaminants (Figure 4, Table 2). A marina is defined as “any water area with a structure (dock, basin, floating dock, etc.) which is utilized for docking or otherwise mooring vessels and constructed to provide temporary or permanent docking space for more than 10 boats” (15A NCAC 18A .0901). The waters enclosed by a marina are classified 1 as Prohibited for the harvest of shellfish, and an additional area beyond the marina can also be classified as Prohibited depending on the number of boat slips present. Overall, eleven docking facilities were evaluated within the C-1 growing area. The Bayshore Marina, which is located off of Chadwick Bay, was found to include 77 slips on the most recent survey. The existing buffer closure surrounding this marina is sized based off of previous surveys indicating a total of 75 slips, so an expanded closure may be necessary. Shellfish Sanitation Staff are currently working with the North Carolina Division of Coastal Management to determine if these additional slips were properly permitted, and once a determination is made, the closure will be adjusted as needed. In early 2015, Swan Point Marina was issued a permit to replace a bulkhead and to excavate the marina basin, and construction was ongoing during this survey. No additional slips were authorized within this permit, so no changes in slip count are expected. Stormwater – Stormwater can adversely impact shellfish growing waters by rapidly transporting fecal coliform bacteria and other contaminants from the land to the water. Runoff from residential areas, roadways, and other cleared land is a contributor to bacterial contamination within the waters of C-1 (Figure 5). There has been a spike in residential and commercial development around Mill Creek and Alligator Bay in recent years, and the cumulative impacts of stormwater runoff from all of these newly developed areas is of particular concern. Subdivisions – Subdivisions are noted in the survey as an indicator of population growth, as well as for their tendency to concentrate potential sources of pollution such as septic systems, pet wastes, and stormwater (Figure 6, Table 3). The areas surrounding Mill Creek and Alligator Bay have continued to experience rapid growth in the last several years, and two new subdivisions, Nautical Reach and Marsh Haven, were noted during this survey. Nautical Reach, located along the upper portion of Mill Creek, currently includes 144 lots and 44 homes, all of which are served by the nearby Pluris Wastewater Treatment Plant. Marsh Haven, along the shore of Alligator Bay, includes 149 lots and 46 homes. One additional subdivision, Tidewater on the Bay, has been in the planning stages since 2007, but has recently begun taking preliminary steps towards development. Plans for this subdivision include 227 lots spread across 383 acres. Of the existing subdivisions in the area, three of those experiencing the most rapid growth are also located near to Mill Creek and Alligator Bay. The Landing at Mill Creek has shown an increase in homes from 55 in 2012 up to 132 at the present, while Mimosa Bay has increased from 11 to 209 during that same time period. Old Millstone Landing has also added several new homes, increasing from 9 in 2012 up to 25 currently. The remainder of the growing area has experienced more moderate growth, and only one additional new subdivision was noted during the survey. Live Oak Cove, located at the head of Chadwick Bay, currently includes 19 lots and 11 homes. 2 Onsite Wastewater – Although the majority of this growing area is served by a municipal wastewater system, a number of homes around Chadwick Bay make use of on-site wastewater systems for wastewater disposal. Many of these systems were visited and inspected during this survey, and all were found to be functioning well. The Bayshore Marina and Racquet Club makes use of a community low-pressure pipe drainfield for wastewater disposal (Figure 7, Table 4). Although the system was functioning properly at the time, there was evidence during the site visit that effluent had previously surfaced at certain locations around the drainfield. This site visit was made shortly after the 4th of July holiday, so it is possible that unusually high flows caused short-term problems with the system. Followup visits were made to this site at a later date, and no further evidence of problems was observed. Wastewater Treatment Plants – The Pluris Wastewater Treatment Plant makes use of two separate components for wastewater treatment. The first is a lagoon style wastewater treatment system with chlorine disinfection and sprayfields for effluent disposal. The second is a membrane bioreactor style system that makes use of UV disinfection and high rate infiltration ponds for effluent disposal. A subsurface drainage system has been built around the perimeter of these ponds to keep groundwater levels low. This drainage system has been designed to send collected groundwater to a lagoon for storage and reuse, although if the lagoon is full, additional groundwater is discharged to a 500 foot level spreader. No significant issues were noted during visits to the plant, lagoons, and sprayfields. Additionally, a review of Division of Water Resources inspection reports revealed no issues relating to disinfection or effluent quality, and no bacterial limit violations or sewer overflows were noted. Overall, fifty-three liftstations were noted within the C-1 growing area. All include warning systems that can notify the utility should a failure occur, but most do not include a backup generator in case of power failure. Golf Courses – The North Shore Country Club is an 18-hole course spread across about 130 acres near Mill Creek (Figure 8, Table 5). This course makes use of well water for irrigation. Wildlife and Domestic Animals – There is extensive habitat available for deer and other wildlife throughout much of the growing area. Livestock populations are minimal, although there is a community horse stable near to Charles Creek within the Escoba Bay subdivision (Figure 9, Table 6). 1.3 HYDROGRAPHIC FACTORS RESPONSIBLE FOR THE SPREAD OF POLLUTION Currents and tides within the C-1 area are primarily influenced by the New River Inlet. Salinities are generally high, and ranged from 16 to 39 parts per thousand during the period covered within this survey (Table 7). Stormwater runoff is one of the major sources of contamination within the growing area, and the Conditionally Approved Open portions of C-1 are temporarily closed following a rainfall event of 1.5 inches or greater within a 24-hour period. Overall, portions of C-1 were temporarily closed 3 41 times for a total of 321 days during the time frame of this report (Table 8). 5 of these closures, totaling 38 days, were due to extremely heavy rainfall associated with hurricanes or tropical storms, while the remaining closures were due to individual rainfall events that exceeded the management criteria. Table 9 contains conditional sampling results collected to reopen the C-1 area after temporary closures. During the period of this report, two rain gauge stations have been used to monitor rainfall for the C-1 area (Table 10). Additional online resources have been used as well. 1.4 BACTERIOLOGICAL SURVEY OF SHELLFISH GROWING WATERS The monitoring of Area C-1 adheres to the systematic random sampling strategy outlined by the National Shellfish Sanitation Program (NSSP), and consists of 30 sample sets from each of 19 sampling stations (Figure 2). The bacteriological survey covered within this report includes water samples taken between 1/31/2011 and 10/28/2015. Water samples were collected and analyzed for fecal coliform bacteria in compliance with the systematic random sampling regime. Table 11 lists, for each individual sampling station, the date the sample was obtained, the tidal cycle upon which the sample was taken, and the ambient salinity. Fecal coliform Most Probable Number (MPN) and summary statistics are included as well. Of the 19 sampling stations monitored during this survey period, all but one meet NSSP criteria for Approved status. However, a number of stations have shown declines in bacteriological water quality since the last Sanitary Survey Report was completed in 2012. Of particular note is station 2, located within the Conditionally Approved Open portion of Fullard Creek. This station has shown a steady decline in water quality since 2009, trending from an estimated 90th percentile of 18 in 2009 to a 25 in 2012 to a 38 on the current survey. The only station currently exceeding the standards for Approved status within the C-1 growing area is station 17, located in Prohibited waters near the confluence of Mill Creek and Alligator Bay. Nearby station 16A, located just outside of the closure line in Alligator Bay, exhibits an estimated 90th percentile of 26, so it appears that the water quality issues do not extend beyond the Prohibited waters of the creek. 1.5 SUMMARY OF BACTERIOLOGICAL DATA ANALYSIS Currently, only sampling station #17, located in the Prohibited waters of Mill Creek, exceeds the NSSP criteria for Approved status. Table 12 provides a summary of bacteriological data for each station within the growing area. 1.6 OVERALL EVALUATION AND RECOMMENDATIONS Several stations within C-1 have shown declines in bacteriological water quality since the 2012 Sanitary Survey Report was completed, but only one station currently exceeds the criteria for Approved status. No changes in classification will be recommended as a result of this report, although Fullard Creek will be monitored closely in the upcoming months for any further 4 declines in water quality. Once a compliance determination is made on the increased slip count at the Bayshore Marina, an expansion of the buffer closure will be made if necessary. 2.0 CONDITIONAL AREA MANAGEMENT PLAN 2.1 INTRODUCTION Area C-1 consists of all waters between Intracoastal Waterway (ICWW) Channel Marker #4 near Swan Point and ICWW Channel Marker #25 near Alligator Bay, including Chadwick Bay, Fullard Creek, Bumps Creek, Biglings Creek, Hell Gate Creek, Charles Creek, Alligator Bay, Mill Creek, and a portion of the Intracoastal Waterway. Overall, the area includes a total of approximately 3,955 water acres (Figure 1). All waters within the C-1 growing area that are not classified as Prohibited are considered Conditionally Approved and are normally open to shellfish harvest, but close following 1.5 inches of rain or greater within a 24-hour period (Figure 2). 2.2 MANAGEMENT PLAN Rainfall resulting in significant runoff is the single largest contributor to the bacterial contamination of shellfishing waters within coastal North Carolina. The Conditionally Approved Open portion of Area C-1 will be recommended closed after receiving 1.5 inches of rain or greater within a 24-hour period. When such rain events occur, the following closure will be recommended: All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge. The Conditionally Approved Open waters of C-1 will then remain closed until such time as the rainfall event has ended, sampling indicates that water quality meets approved area criteria, and the shellfish have had sufficient time to cleanse. There are two rain gauge station within the C-1 growing area that regularly submit monthly rainfall calendars to the Shellfish Sanitation office, and others that are available by telephone to provide rainfall data when rain in the area is suspected. Rainfall amounts can be called in to the DMF Communications Center in Morehead City, and are checked regularly by the Shellfish Sanitation personnel to determine if closures are necessary. In accordance with 15A NCAC 18A .0913, an immediate temporary closure of shellfishing waters within the C-1 area will be made in the event of a public health emergency. A public health emergency means any condition that may immediately cause shellfish waters to be unsafe for the harvest of shellfish for human consumption. 5 2.3 IMPLEMENTATION OF MANAGEMENT PLAN If the rainfall level in the management plan for the area is exceeded, a proclamation is issued by DMF resulting in an immediate closure of the area. The proclamation is issued by fax, mail, email, and by area law enforcement officers who in turn distribute it to local establishments in the affected area for public notification. After hours and on weekends, Shellfish Sanitation personnel will be in contact with rain gauge monitors and with the DMF Communications Center for information regarding rainfall reports. The DMF Communications Center is on duty 24 hours per day. 2.4 PATROL OF CLOSED AREA Patrol of shellfish harvesting areas is the sole responsibility of the Division of Marine Fisheries Marine Patrol Section. For information regarding enforcement of closures and patrol of closed areas, see the Patrol Policy of the DMF Marine Patrol Section. 2.5 REOPENING CRITERIA After the rainfall event has ended and sufficient time has elapsed to allow shellfish to cleanse, the temporarily closed area will be sampled. If the results indicate that fecal coliform levels are acceptable, a proclamation is issued to reopen the area. In accordance with 15A NCAC 113-221 of the DMF rules, a 12-hour notification period is required prior to the reopening of closed shellfishing areas. Changes to this management plan may be necessary as additional data is collected. At the present time, a conservative approach will be taken with regard to temporary closures with the interest of public health in mind. 3.0 CONDITIONAL AREA EVALUATION 3.1 INTRODUCTION The National Shellfish Sanitation Program (NSSP) Conditionally Approved classification for shellfish growing waters allows the utilization of valuable shellfish resources by permitting harvesting when environmental conditions cause fecal coliform levels to be satisfactory in areas that would otherwise be closed to the harvesting of shellfish. In order for the State to be in compliance with NSSP guidelines, conditionally approved areas must be evaluated yearly in accordance with the Model Ordinance, Chapter IV, @ 03, C., (3), (a) and (b) of the NSSP Guide for the Control of Molluscan Shellfish. This report is intended to comply with that portion of the NSSP yearly evaluation of the Conditionally Approved areas for the Mill Creek Area, C-1, in Onslow County. Each of the six required elements of the evaluation will be included in this report. 6 3.2 COMPLIANCE WITH MANAGEMENT PLAN The monitoring of Area C-1 adheres to the systematic random sampling strategy outlined by the NSSP, and consists of 30 sample sets from 19 sampling stations used during this report period (Figure 2). The area has also been sampled in accordance with management plan criteria for the conditionally approved classification of the NSSP. Rain events that exceed management plan criteria of 1.5 inches of rain within a 24-hour period result in a temporary closure of the affected conditionally approved area. Table 8 contains a list of temporary closures of conditionally approved waters that have occurred within C-1 during this survey period. Review of the management plan for Area C-1 during the time period of this report indicates that all closures were made in accordance with the requirements of the plan. Over the time period covered within this report, portions of this area have been closed 41 times for a total of 321 days. Adequate water samples were obtained prior to reopening after these rainfall events (Table 9), to ensure that bacteriological water quality was sufficient to protect public health according to the plan criteria. 3.3 ADEQUACY OF REPORTING For coastal North Carolina, rainfall and the resultant runoff is the event most detrimental to shellfish water quality. Currently, all management plans for conditionally approved waters are dependent upon the amount of rainfall received within the watershed of a particular growing area. The process of developing management plans for conditionally approved areas is complex. Rainfall amounts can vary tremendously, and there are often significant differences in accumulation within a small area. Current procedures for obtaining rainfall data include the use of local volunteer rainfall stations, as well as NOAA and other commercial weather websites. Rainfall accumulations recorded at the C-1 rain gauge stations are included in Table 10. 3.4 COOPERATION OF PERSONS INVOLVED The conditionally approved area concept is a cooperative effort between the Marine Patrol and Shellfish Sanitation Section of the Division of Marine Fisheries (DMF). The Shellfish Sanitation Section is responsible for monitoring conditionally approved growing areas and developing management plans. Patrol of shellfish harvesting waters is the sole responsibility of the DMF Marine Patrol. The administrative procedures to implement these actions are outlined in a memorandum of understanding between the Division of Marine Fisheries and the Shellfish Sanitation Section. No major problems have occurred with implementing the conditionally approved area concept in North Carolina. Rainfall information is gathered from various individuals throughout the state including private citizens, DMF Marine Patrol, and Shellfish Sanitation personnel. Additional resources are used to determine the amount and locations of precipitation, such as the NOAA National Weather Service precipitation website. 7 3.5 COMPLIANCE WITH APPROVED GROWING AREA CRITERIA All stations located within the conditionally managed portions of Area C-1 currently meet the standards for Approved status, and no changes in classification will be recommended as a results of this report. 3.6 FIELD INSPECTION OF POLLUTION SOURCES A comprehensive shoreline survey of the C-1 area was completed in August 2015, in accordance with the requirements of the NSSP “Guide for the Control of Molluscan Shellfish,” Chapter IV, @ .03. 3.7 COLLECTION OF WATER SAMPLES Area C-1 has been sampled in accordance with the management plan criteria of the area as required by the conditionally approved classification of the NSSP. Area C-1 currently adheres to the systematic random sampling strategy outlined by the NSSP, and has consisted of 30 sample sets from 19 stations used during this survey period. The bacteriological survey covered within this report includes water samples gathered between 1/31/2011 and 10/28/2015. During that time period, a total of 570 water samples were collected when the waters were open to shellfish harvesting, and each was analyzed for fecal coliform bacteria in compliance with the systematic random sampling regime. Table 11 lists, for each individual sampling station, the date the sample was obtained, the tidal cycle upon which the sample was taken, and the ambient salinity. Fecal coliform MPN and summary statistics are listed here as well. In addition, 157 bacteriological samples were collected and analyzed as part of the conditional and temporary area sampling for C-1 (Table 9). 3.8 SUMMARY The Conditionally Approved area classification of the NSSP provides a way to utilize a resource for direct market purposes that would otherwise only be available for relaying or depuration. Data Summary 50 The C-1 area of coastal North Carolina lies just south and west of the New River in Onslow County. Review of the bacteriological and shoreline survey data collected during the time period covered within this report indicates that there has been some widespread decline in bacteriological water quality throughout the area, although only one sampling station currently exceeds the standards for Approved status. No changes in classification will be recommended, and the current Conditional Area Management Plan will continue to be used. 1.0 SANITARY SURVEY 1.1 INTRODUCTION The C-1 growing area is composed of all waters between Intracoastal Waterway (ICWW) Channel Marker #4 near Swan Point and ICWW Channel Marker #25 near Alligator Bay, including Chadwick Bay, Fullard Creek, Bumps Creek, Biglings Creek, Hell Gate Creek, Charles Creek, Alligator Bay, Mill Creek, and a portion of the Intracoastal Waterway. Overall, the area includes a total of approximately 3,955 water acres (Figure 1). The communities of Sneads Ferry, Peru, Chadwick Acres, and North Topsail Beach line the shores of the growing area, and according to US Census Block Data from 2010, the permanent population within the C-1 watershed is about 4,226. See Figure 2 for a map of the growing area, including sampling station locations, and see Table 1 for a description of those sampling stations. 1.2 SHORELINE SURVEY OF POLLUTION SOURCES A comprehensive shoreline survey of Area C-1 was completed in August 2015. Evaluations of properties in the area were conducted by NC Shellfish Sanitation staff to determine potential sources of pollution entering shellfish growing waters (Figure 3). The Onslow County Health Department was notified prior to the survey, and agreed to provide corrective action and follow-up for any malfunctioning septic systems or illegal on-site wastewater discharges discovered. Survey Methods New actual and potential pollution sources for this survey were mapped using GPS, and pollution source data were collected using Trimble’s sub-meter GeoXT GPS receiver with EVEREST multipath rejection technology. Data were collected in the SSF format using real-time corrections from the integrated Wide Area Augmentation System receiver. The data were post-processed using GPS Pathfinder Tools applications in order to get the most precise data. Additionally, a Geographic Information System (GIS) was developed, including pertinent information and digital pictures for each source. Non-Point Source Pollution Marinas – Marinas and dockage facilities are evaluated during the shoreline survey because of their potential to affect the suitability of adjacent shellfish waters for harvest through inputs of both biological and chemical contaminants (Figure 4, Table 2). A marina is defined as “any water area with a structure (dock, basin, floating dock, etc.) which is utilized for docking or otherwise mooring vessels and constructed to provide temporary or permanent docking space for more than 10 boats” (15A NCAC 18A .0901). The waters enclosed by a marina are classified 1 as Prohibited for the harvest of shellfish, and an additional area beyond the marina can also be classified as Prohibited depending on the number of boat slips present. Overall, eleven docking facilities were evaluated within the C-1 growing area. The Bayshore Marina, which is located off of Chadwick Bay, was found to include 77 slips on the most recent survey. The existing buffer closure surrounding this marina is sized based off of previous surveys indicating a total of 75 slips, so an expanded closure may be necessary. Shellfish Sanitation Staff are currently working with the North Carolina Division of Coastal Management to determine if these additional slips were properly permitted, and once a determination is made, the closure will be adjusted as needed. In early 2015, Swan Point Marina was issued a permit to replace a bulkhead and to excavate the marina basin, and construction was ongoing during this survey. No additional slips were authorized within this permit, so no changes in slip count are expected. Stormwater – Stormwater can adversely impact shellfish growing waters by rapidly transporting fecal coliform bacteria and other contaminants from the land to the water. Runoff from residential areas, roadways, and other cleared land is a contributor to bacterial contamination within the waters of C-1 (Figure 5). There has been a spike in residential and commercial development around Mill Creek and Alligator Bay in recent years, and the cumulative impacts of stormwater runoff from all of these newly developed areas is of particular concern. Subdivisions – Subdivisions are noted in the survey as an indicator of population growth, as well as for their tendency to concentrate potential sources of pollution such as septic systems, pet wastes, and stormwater (Figure 6, Table 3). The areas surrounding Mill Creek and Alligator Bay have continued to experience rapid growth in the last several years, and two new subdivisions, Nautical Reach and Marsh Haven, were noted during this survey. Nautical Reach, located along the upper portion of Mill Creek, currently includes 144 lots and 44 homes, all of which are served by the nearby Pluris Wastewater Treatment Plant. Marsh Haven, along the shore of Alligator Bay, includes 149 lots and 46 homes. One additional subdivision, Tidewater on the Bay, has been in the planning stages since 2007, but has recently begun taking preliminary steps towards development. Plans for this subdivision include 227 lots spread across 383 acres. Of the existing subdivisions in the area, three of those experiencing the most rapid growth are also located near to Mill Creek and Alligator Bay. The Landing at Mill Creek has shown an increase in homes from 55 in 2012 up to 132 at the present, while Mimosa Bay has increased from 11 to 209 during that same time period. Old Millstone Landing has also added several new homes, increasing from 9 in 2012 up to 25 currently. The remainder of the growing area has experienced more moderate growth, and only one additional new subdivision was noted during the survey. Live Oak Cove, located at the head of Chadwick Bay, currently includes 19 lots and 11 homes. 2 Onsite Wastewater – Although the majority of this growing area is served by a municipal wastewater system, a number of homes around Chadwick Bay make use of on-site wastewater systems for wastewater disposal. Many of these systems were visited and inspected during this survey, and all were found to be functioning well. The Bayshore Marina and Racquet Club makes use of a community low-pressure pipe drainfield for wastewater disposal (Figure 7, Table 4). Although the system was functioning properly at the time, there was evidence during the site visit that effluent had previously surfaced at certain locations around the drainfield. This site visit was made shortly after the 4th of July holiday, so it is possible that unusually high flows caused short-term problems with the system. Followup visits were made to this site at a later date, and no further evidence of problems was observed. Wastewater Treatment Plants – The Pluris Wastewater Treatment Plant makes use of two separate components for wastewater treatment. The first is a lagoon style wastewater treatment system with chlorine disinfection and sprayfields for effluent disposal. The second is a membrane bioreactor style system that makes use of UV disinfection and high rate infiltration ponds for effluent disposal. A subsurface drainage system has been built around the perimeter of these ponds to keep groundwater levels low. This drainage system has been designed to send collected groundwater to a lagoon for storage and reuse, although if the lagoon is full, additional groundwater is discharged to a 500 foot level spreader. No significant issues were noted during visits to the plant, lagoons, and sprayfields. Additionally, a review of Division of Water Resources inspection reports revealed no issues relating to disinfection or effluent quality, and no bacterial limit violations or sewer overflows were noted. Overall, fifty-three liftstations were noted within the C-1 growing area. All include warning systems that can notify the utility should a failure occur, but most do not include a backup generator in case of power failure. Golf Courses – The North Shore Country Club is an 18-hole course spread across about 130 acres near Mill Creek (Figure 8, Table 5). This course makes use of well water for irrigation. Wildlife and Domestic Animals – There is extensive habitat available for deer and other wildlife throughout much of the growing area. Livestock populations are minimal, although there is a community horse stable near to Charles Creek within the Escoba Bay subdivision (Figure 9, Table 6). 1.3 HYDROGRAPHIC FACTORS RESPONSIBLE FOR THE SPREAD OF POLLUTION Currents and tides within the C-1 area are primarily influenced by the New River Inlet. Salinities are generally high, and ranged from 16 to 39 parts per thousand during the period covered within this survey (Table 7). Stormwater runoff is one of the major sources of contamination within the growing area, and the Conditionally Approved Open portions of C-1 are temporarily closed following a rainfall event of 1.5 inches or greater within a 24-hour period. Overall, portions of C-1 were temporarily closed 3 41 times for a total of 321 days during the time frame of this report (Table 8). 5 of these closures, totaling 38 days, were due to extremely heavy rainfall associated with hurricanes or tropical storms, while the remaining closures were due to individual rainfall events that exceeded the management criteria. Table 9 contains conditional sampling results collected to reopen the C-1 area after temporary closures. During the period of this report, two rain gauge stations have been used to monitor rainfall for the C-1 area (Table 10). Additional online resources have been used as well. 1.4 BACTERIOLOGICAL SURVEY OF SHELLFISH GROWING WATERS The monitoring of Area C-1 adheres to the systematic random sampling strategy outlined by the National Shellfish Sanitation Program (NSSP), and consists of 30 sample sets from each of 19 sampling stations (Figure 2). The bacteriological survey covered within this report includes water samples taken between 1/31/2011 and 10/28/2015. Water samples were collected and analyzed for fecal coliform bacteria in compliance with the systematic random sampling regime. Table 11 lists, for each individual sampling station, the date the sample was obtained, the tidal cycle upon which the sample was taken, and the ambient salinity. Fecal coliform Most Probable Number (MPN) and summary statistics are included as well. Of the 19 sampling stations monitored during this survey period, all but one meet NSSP criteria for Approved status. However, a number of stations have shown declines in bacteriological water quality since the last Sanitary Survey Report was completed in 2012. Of particular note is station 2, located within the Conditionally Approved Open portion of Fullard Creek. This station has shown a steady decline in water quality since 2009, trending from an estimated 90th percentile of 18 in 2009 to a 25 in 2012 to a 38 on the current survey. The only station currently exceeding the standards for Approved status within the C-1 growing area is station 17, located in Prohibited waters near the confluence of Mill Creek and Alligator Bay. Nearby station 16A, located just outside of the closure line in Alligator Bay, exhibits an estimated 90th percentile of 26, so it appears that the water quality issues do not extend beyond the Prohibited waters of the creek. 1.5 SUMMARY OF BACTERIOLOGICAL DATA ANALYSIS Currently, only sampling station #17, located in the Prohibited waters of Mill Creek, exceeds the NSSP criteria for Approved status. Table 12 provides a summary of bacteriological data for each station within the growing area. 1.6 OVERALL EVALUATION AND RECOMMENDATIONS Several stations within C-1 have shown declines in bacteriological water quality since the 2012 Sanitary Survey Report was completed, but only one station currently exceeds the criteria for Approved status. No changes in classification will be recommended as a result of this report, although Fullard Creek will be monitored closely in the upcoming months for any further 4 declines in water quality. Once a compliance determination is made on the increased slip count at the Bayshore Marina, an expansion of the buffer closure will be made if necessary. 2.0 CONDITIONAL AREA MANAGEMENT PLAN 2.1 INTRODUCTION Area C-1 consists of all waters between Intracoastal Waterway (ICWW) Channel Marker #4 near Swan Point and ICWW Channel Marker #25 near Alligator Bay, including Chadwick Bay, Fullard Creek, Bumps Creek, Biglings Creek, Hell Gate Creek, Charles Creek, Alligator Bay, Mill Creek, and a portion of the Intracoastal Waterway. Overall, the area includes a total of approximately 3,955 water acres (Figure 1). The communities of Sneads Ferry, Peru, Chadwick Acres, and North Topsail Beach line the shores of the growing area, and according to US Census Block Data from 2010, the permanent population within the C-1 watershed is about 4,226. All waters within the C-1 growing area that are not classified as Prohibited are considered Conditionally Approved and are normally open to shellfish harvest, but close following 1.5 inches of rain or greater within a 24-hour period (Figure 2). 2.2 MANAGEMENT PLAN Rainfall resulting in significant runoff is the single largest contributor to the bacterial contamination of shellfishing waters within coastal North Carolina. The Conditionally Approved Open portion of Area C-1 will be recommended closed after receiving 1.5 inches of rain or greater within a 24-hour period. When such rain events occur, the following closure will be recommended: All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge. The Conditionally Approved Open waters of C-1 will then remain closed until such time as the rainfall event has ended, sampling indicates that water quality meets approved area criteria, and the shellfish have had sufficient time to cleanse. There are two rain gauge station within the C-1 growing area that regularly submit monthly rainfall calendars to the Shellfish Sanitation office, and others that are available by telephone to provide rainfall data when rain in the area is suspected. Rainfall amounts can be called in to the DMF Communications Center in Morehead City, and are checked regularly by the Shellfish Sanitation personnel to determine if closures are necessary. In accordance with 15A NCAC 18A .0913, an immediate temporary closure of shellfishing waters within the C-1 area will be made in the event of a public health emergency. A public health emergency means any condition that may immediately cause shellfish waters to be unsafe for the harvest of shellfish for human consumption. 5 2.3 IMPLEMENTATION OF MANAGEMENT PLAN If the rainfall level in the management plan for the area is exceeded, a proclamation is issued by DMF resulting in an immediate closure of the area. The proclamation is issued by fax, mail, email, and by area law enforcement officers who in turn distribute it to local establishments in the affected area for public notification. After hours and on weekends, Shellfish Sanitation personnel will be in contact with rain gauge monitors and with the DMF Communications Center for information regarding rainfall reports. The DMF Communications Center is on duty 24 hours per day. 2.4 PATROL OF CLOSED AREA Patrol of shellfish harvesting areas is the sole responsibility of the Division of Marine Fisheries Marine Patrol Section. For information regarding enforcement of closures and patrol of closed areas, see the Patrol Policy of the DMF Marine Patrol Section. 2.5 REOPENING CRITERIA After the rainfall event has ended and sufficient time has elapsed to allow shellfish to cleanse, the temporarily closed area will be sampled. If the results indicate that fecal coliform levels are acceptable, a proclamation is issued to reopen the area. In accordance with 15A NCAC 113-221 of the DMF rules, a 12-hour notification period is required prior to the reopening of closed shellfishing areas. Changes to this management plan may be necessary as additional data is collected. At the present time, a conservative approach will be taken with regard to temporary closures with the interest of public health in mind. 3.0 CONDITIONAL AREA EVALUATION 3.1 INTRODUCTION The National Shellfish Sanitation Program (NSSP) Conditionally Approved classification for shellfish growing waters allows the utilization of valuable shellfish resources by permitting harvesting when environmental conditions cause fecal coliform levels to be satisfactory in areas that would otherwise be closed to the harvesting of shellfish. In order for the State to be in compliance with NSSP guidelines, conditionally approved areas must be evaluated yearly in accordance with the Model Ordinance, Chapter IV, @ 03, C., (3), (a) and (b) of the NSSP Guide for the Control of Molluscan Shellfish. This report is intended to comply with that portion of the NSSP yearly evaluation of the Conditionally Approved areas for the Mill Creek Area, C-1, in Onslow County. Each of the six required elements of the evaluation will be included in this report. 6 3.2 COMPLIANCE WITH MANAGEMENT PLAN The monitoring of Area C-1 adheres to the systematic random sampling strategy outlined by the NSSP, and consists of 30 sample sets from 19 sampling stations used during this report period (Figure 2). The area has also been sampled in accordance with management plan criteria for the conditionally approved classification of the NSSP. Rain events that exceed management plan criteria of 1.5 inches of rain within a 24-hour period result in a temporary closure of the affected conditionally approved area. Table 8 contains a list of temporary closures of conditionally approved waters that have occurred within C-1 during this survey period. Review of the management plan for Area C-1 during the time period of this report indicates that all closures were made in accordance with the requirements of the plan. Over the time period covered within this report, portions of this area have been closed 41 times for a total of 321 days. Adequate water samples were obtained prior to reopening after these rainfall events (Table 9), to ensure that bacteriological water quality was sufficient to protect public health according to the plan criteria. 3.3 ADEQUACY OF REPORTING For coastal North Carolina, rainfall and the resultant runoff is the event most detrimental to shellfish water quality. Currently, all management plans for conditionally approved waters are dependent upon the amount of rainfall received within the watershed of a particular growing area. The process of developing management plans for conditionally approved areas is complex. Rainfall amounts can vary tremendously, and there are often significant differences in accumulation within a small area. Current procedures for obtaining rainfall data include the use of local volunteer rainfall stations, as well as NOAA and other commercial weather websites. Rainfall accumulations recorded at the C-1 rain gauge stations are included in Table 10. 3.4 COOPERATION OF PERSONS INVOLVED The conditionally approved area concept is a cooperative effort between the Marine Patrol and Shellfish Sanitation Section of the Division of Marine Fisheries (DMF). The Shellfish Sanitation Section is responsible for monitoring conditionally approved growing areas and developing management plans. Patrol of shellfish harvesting waters is the sole responsibility of the DMF Marine Patrol. The administrative procedures to implement these actions are outlined in a memorandum of understanding between the Division of Marine Fisheries and the Shellfish Sanitation Section. No major problems have occurred with implementing the conditionally approved area concept in North Carolina. Rainfall information is gathered from various individuals throughout the state including private citizens, DMF Marine Patrol, and Shellfish Sanitation personnel. Additional resources are used to determine the amount and locations of precipitation, such as the NOAA National Weather Service precipitation website. 7 3.5 COMPLIANCE WITH APPROVED GROWING AREA CRITERIA All stations located within the conditionally managed portions of Area C-1 currently meet the standards for Approved status, and no changes in classification will be recommended as a results of this report. 3.6 FIELD INSPECTION OF POLLUTION SOURCES A comprehensive shoreline survey of the C-1 area was completed in August 2015, in accordance with the requirements of the NSSP “Guide for the Control of Molluscan Shellfish,” Chapter IV, @ .03. 3.7 COLLECTION OF WATER SAMPLES Area C-1 has been sampled in accordance with the management plan criteria of the area as required by the conditionally approved classification of the NSSP. Area C-1 currently adheres to the systematic random sampling strategy outlined by the NSSP, and has consisted of 30 sample sets from 19 stations used during this survey period. The bacteriological survey covered within this report includes water samples gathered between 1/31/2011 and 10/28/2015. During that time period, a total of 570 water samples were collected when the waters were open to shellfish harvesting, and each was analyzed for fecal coliform bacteria in compliance with the systematic random sampling regime. Table 11 lists, for each individual sampling station, the date the sample was obtained, the tidal cycle upon which the sample was taken, and the ambient salinity. Fecal coliform MPN and summary statistics are listed here as well. In addition, 157 bacteriological samples were collected and analyzed as part of the conditional and temporary area sampling for C-1 (Table 9). 3.8 SUMMARY The Conditionally Approved area classification of the NSSP provides a way to utilize a resource for direct market purposes that would otherwise only be available for relaying or depuration.
