Page 1 In 2007, water issues once again came to the environmental forefront in North Carolina, as the state wrestled not only with one of its worst droughts in recent history, but with the potential for that drought to continue well into the next calendar year and beyond. Whenever water quantity becomes an issue, attention is focused on water quality as well, and the importance of protecting and preserving the state’s existing water resources is underscored. In the 11 years since its creation, the N.C. Clean Water Management Trust Fund has gained a reputation as one of the state’s premiere water conservation and protection agencies. In August 1996, the General Assembly approved landmark legislation creating the trust fund in response to public outcry over the polluted condition of the Neuse River. Since that time, CWMTF has played key roles in protecting water quality in all 17 of the state’s river basins, and has helped preserve key North Carolina landmarks such as Grandfather Mountain, Bird Island, DuPont State Forest, Chimney Rock, and the Alligator River. In 2007, CWMTF and its partners celebrated the conservation of Cowee Mound in Cherokee County, Jones Island in Carteret County, Lake Rhodhiss, the Neuse River in Wake County, and the completion of a major stormwater management project in Wilmington. During its consideration of grants in 2007, the CWMTF Board of Trustees refocused attention on providing low-income communities with resources to address their wastewater management needs, and it prepared to integrate innovative methods into the criteria for stormwater management grants in 2008. CWMTF also changed leadership during 2007. Following the resignation of Bill Holman in December 2006, Richard E. Rogers, Jr. was hired by the CWMTF Board of Trustees and became the fund’s third executive director. His appointment was effective August 1, 2007. Introduction Page 2 The General Assembly, in its legislation that enacted CWMTF (Chapter 113A Article 18 (GS 113A-251 et seq.)), gave the new agency a clear mandate: “to clean up pollution in the state’s surface waters and to protect and conserve those waters that are not yet polluted.” The CWMTF “shall be used to help finance projects that specifically address water pollution problems and focus on upgrading surface waters, eliminating pollution, and protecting and conserving unpolluted surface waters, including urban drinking water supplies” and “to build a network of riparian buffers and greenways for environmental, educational, and recreational benefit.” CWMTF’s influence on water quality over the last decade extends well beyond the Neuse River Basin. Conservation of forested buffers along key waterways, wastewater improvements, restoration of wetlands and stream banks to curb erosion and stormwater management for cities and towns has resulted in cleaner water for all of North Carolina – from Murphy to Manteo. CWMTF’s non-regulatory, incentive-based grants complement North Carolina’s environmental regulatory and educational programs and help ensure both a strong economy and healthy environment. The CWMTF is an independent agency housed for administrative purposes in the Department of Environment and Natural Resources (DENR). A 21-member board of trustees establishes criteria, allocates funds, reviews applications, approves grants, and hires the executive director. Seven members are appointed by the Governor; seven by the General Assembly upon the recommendation of the President Pro Tempore of the Senate; and seven by the General Assembly upon the recommendation of the Speaker Page 3 Background of the House. An advisory council composed of the Commissioner of Agriculture, Chair of the Wildlife Resources Commission, Secretary of DENR, and Secretary of Commerce or their designees advises the board of trustees. Local governments, state agencies, and nonprofit conservation organizations, such as land trusts, may apply for grants. Moneys from CWMTF may be used to acquire conservation easements or land in fee simple to preserve riparian buffers, wetlands, floodplains, and greenways; to restore riparian buffers, streams, and wetlands; to repair failing wastewater collection and treatment systems; to eliminate failing septic tanks and straight pipes; to prevent, reduce, collect and treat stormwater pollution; and to plan water quality projects. The board works through three principal committees: acquisitions, infrastructure/wastewater, and restoration/stormwater. The executive director, two deputy directors, real property counsel, wastewater infrastructure project manager, restoration and stormwater project manager, administrative officer, communications director, paralegal, executive assistant, and office assistant are based in the central office in Raleigh. Five field representatives cover the coast, piedmont and mountain regions of the state. In 2008, a part-time water quality advisor will be changed to a full-time position and moved to the central office and a stewardship coordinator will be added to the Raleigh CWMTF staff. Administration In 2007, the CWMTF continued to make significant strides in funding projects to improve water quality throughout the state. In the last year, CWMTF also continued to help the state achieve its goal of preserving a million acres of open space, as set out in GS 113A-240, and further assisted Governor Easley implement his One North Carolina Naturally initiative. As of 2007 CWMTF has: • helped preserve over 439,000 acres of land, thereby ensuring streams, rivers, lakes and shellfishing waters will be able to support their uses for drinking water, recreation, fisheries and other uses; • helped protect over 4,500 miles of riparian bufers; • invested more than $446.6 million in land and water conservation; • funded 135 riparian bufer, stream and wetland restoration projects totaling more than $85.2 million; • assisted local governments and other applicants with 232 wastewater improvement projects, investing more than $215.3 million to reduce discharges and more effectively treat wastewater so that fewer nutrients and other pollutants enter our rivers, and • funded 89 stormwater management projects totaling more than $48.3 million to reduce pollution from urban runoff and decrease flooding. Progress by the Numbers-2007 The Board of Trustees adopted an annual administrative budget of up to $2,222,400 for fiscal year 2007-2008 at its September 2007 meeting. In 2007, the Board of Trustees met eight times – five times in Raleigh, and in Chapel Hill, Browns Summit, and Marion. In 2008, the Board plans to meet for its off-site planning meeting in February in Durham and then three times in Raleigh and in Winston-Salem and in Hickory for its regular meetings Page 4 Protecting Natural and Cultural Heritage: Cowee Mound Page 5 In 2007, CWMTF celebrated the conservation of the Cowee Mound tract It is almost impossible to separate North Carolina’s natural heritage from its rich cultural heritage. Evidence of the role water resources have played in the development of the Tar Heel State’s cultural traditions is plentiful - one only has to look at the importance of the watermen in coastal Carolina, or of the Native Americans in the Appalachians. One of the best examples of this confluence can be found in Macon County. Cowee Mound, on the Little Tennessee River, is the heart of the ancient settlement of Cowee, a principle commercial center for the mountain Cherokee people. It was also the target of the first military campaign in the South during the American Revolution. In 2007, CWMTF and one of its most successful partners, the Land Trust for the Little Tennessee, celebrated the conservation of the Cowee Mound tract - 68 acres adjacent to the Needmore Gamelands, which extends the 35 miles of existing conservation along the Little Tennessee riverfront. The project, which received a $471,000 grant in 2005 from CWMTF, preserves not only the pristine waters of the Little Tennessee but the heritage of the area’s Cherokee tribe. From a water quality standpoint, preservation of Cowee Mound will prevent development from degrading water quality in one of the state’s cleanest rivers. The section of the river bordering the property is thought to be the only area in the Southern Blue Ridge Mountains retaining its full complement of native aquatic fauna. The river is a federally designated “Critical Habitat” for several important species, including the Spotfin Chub, the Appalachian Elktoe and Little-Wing Pearly Mussels. Protection of the site also preserves the state’s rich cultural heritage. For example, it will allow for the expansion of protective buffers of rivercane canebrake along the waterway. This plant is an important source of raw materials for modern day Cherokee artisans. The area is likely to become an important site for both ecotourism and heritage tourism, perfectly showcasing the connection between our state’s natural resources and its rich mountain traditions. Page 6 Budget and Funding None of CWMTF’s achievements in 2007 would have been possible without the support of the North Carolina legislature. The General Assembly continued its strong support for protecting and restoring water quality in 2007. The FY 2007-2008 budget approved by the legislature once again appropriated $100,000,000 in recurring funds to CWMTF in each year of the biennium. CWMTF will work to justify continued funding at this or an increased level during the remainder of the 2007-2009 biennium, to address the more than $17 billion of needs to protect and restore water quality in North Carolina. Grant Criteria and Low Income Communities In 2007, the CWMTF Board continued to improve CWMTF’s grant review criteria by integrating CWMTF’s existing criteria with the common criteria set out in Session Law 2005-454. As a result, in the 2007 grant cycle, more weight was given to good water quality applications from economically distressed local governments in the category of wastewater treatment grants. In this arena, the board demonstrated its commitment to following the direction of the General Assembly set out in GS 113A-254(a1) to give priority to applications for wastewater collection system projects and wastewater treatment works projects that serve economically distressed local government units. 2007 Legislative Action and Issues Page 7 Innovative Stormwater Management The 2007 General Assembly passed Senate Bill 1468 requiring CWMTF to fund innovative efforts to improve stormwater management. The CWMTF is focusing efforts to encourage innovative stormwater technology and will make funding those types of projects a priority in 2008. On March 1, 2007, CWMTF received 186 applications totaling $155 million, marking the first grant cycle since a decision in 2006 by CMWTF trustees to reduce the number of grant cycles per year from two to one. In addition to considering those new requests for water quality funding, 28 applications deferred from previous cycles were also eligible for consideration in the 2007 cycle, adding an additional $102 million to the amount requested from the agency. 2007 Summary of Projects Page 8 Key projects for the year included: $22.8 million to The Nature Conservancy and N.C. Wildlife Resources Commission to help conclude the historic purchase of the International Paper tracts on Juniper Creek in Brunswick County, and on the Tar, Chowan and Roanoke rivers; $2.4 million to the N.C. Wildlife Resources Commission to help purchase the GMS Tract on the Alligator River; $2.4 million to the Town of Murphy to purchase the Murphy Tract and protect Marble Creek; $3 million to the N.C. Division of Soil and Water Conservation for the continuation of the floodplain swine lagoon buyout program; $1 million to the City of New Bern for stormwater management to protect Jack Smith Creek; $1.9 million to help the Town of Eastover in Cumberland County make improvements to its wastewater treatment system and protect Locks Creek; $3 million to the Town of Burgaw to regionalize its wastewater treatment collection system and protect Burgaw Creek in Pender County; $2.4 million to the Town of Mt. Gilead to rehabilitate its wastewater collection system and protect Clarks Creek in Montgomery County; $2.9 million to the City of Dunn to upgrade its wastewater treatment facility and protect water quality in Mingo Swamp. Thanks to appropriations from the General Assembly and to the closing out of old grants, the CWMTF Board of Trustees approved 217 grants, awarding a total of $119 million, including additional funding awarded to 12 previously approved projects in calendar year 2007. In 2007, the CWMTF Board continued to approve a diverse mix of projects: 50 percent of the approved requests involved land acquisitions; 20 percent involved infrastructure/wastewater projects; 20 percent involved restoration/ stormwater; and the remainder of the 2007 grant awards involved planning projects. One of CWMTF’s most successful land acquisition partnerships continues to be with the N.C. Division of Parks and Recreation. Growth and development in North Carolina hinders NCDPR’s ability to expand. At the same time, it also threatens the state’s water resources. It makes good sense that these two agencies work together on behalf of North Carolina’s natural resources. In 2007, CWMTF awarded the division $4.6 million to help conserve almost 3,000 acres across the state, from South Mountains State Park in the western part of the state, to Pettigrew State Park in eastern North Carolina. Parks protected by CWMTF in 2007 include Eno River State Park, Lake Norman State Park, Merchants Millpond State Park, Pettigrew State Park, Stone Mountain State Park, South Mountains State Park, Lake Waccamaw State Park, and the newly authorized Deep River State Trail centered in Chatham County. “Each year, trustees for these conservation trust funds have become more adept at combining their efforts for effective conservation of our natural resources and support of the state’s One North Carolina Naturally initiative,” said Lewis Ledford, director of the division. “The critical properties to be acquired by these grants will help develop new parks and greatly enhance established parks.” The combined efforts for state parks in 2007 are directed at 24 tracts, the largest being a 1,082-acre property on the Scuppernong River at a newly designated section of Pettigrew State Park in Washington and Tyrell counties. 2007 CWMTF Highlights Acquisitions N.C. Division of Parks and Recreation: Additions to State Parklands Page 9 NC Division of Tourism In 2006, CWMTF joined with North Carolina Chapter of The Nature Conservancy and several other conservation partners to help purchase and preserve some of the most biologically sensitive areas of eastern North Carolina when the International Paper divested itself of its land holdings across the country. At that time, CWMTF invested more than $15.7 million to help purchase the property and protect water quality on well over 58,000 acres along the Roanoke, Chowan and Upper Tar rivers. In 2007, CWMTF helped complete the transaction by awarding another $22.8 million in the form of five grants – priority was placed on securing protection of these ecologically important lands and the finalization of the massive project was completed a year ahead of the expected schedule. The International Paper lands are a critical addition to the acres of stream and river front already under protection by many conservation agencies in the state. They are home not only to waterbodies critical to water quality in eastern North Carolina, but to a whole host of important species – from the endangered red-cockaded woodpecker and the fox squirrel to healthy populations of black bear and river otter. The waters of these rivers are important to North Carolina’s economy as well as its environmental health, as they support many facets of the state’s tourism industries and its fisheries. According to The Nature Conservancy, North Carolina’s acquisition was the largest part of the regional effort to secure the International Paper lands available in the entire Southeast –an effort which spanned 10 states and totaled 218,000 acres of ecologically important rivers, streams and forests. CWMTF is extremely proud to have played a role in this landmark conservation project. Stormwater continues to be one Pofa gNeo r1t0h The Nature Conservancy: International Paper Tracts Phase II Carolina’s biggest water pollution concerns, and nowhere is that more evident than in the state’s urban areas. In 2007, CWMTF awarded the City of Raleigh a $1.1 million grant to fund three stream enhancement projects to help manage stormwater in a center city watershed. The effort will make improvements in the Pigeon House Branch Watershed, which includes three neighborhood parks between the Cameron Park and Five Points neighborhood. Streams running through Smallwood Drive, Cowper Drive and Edna Metz Wells parks will be enhanced to help reduce erosion during heavy rains. The improvements will better manage stormwater runoff from a 450-acre area, most of which is paved surface. The project also includes construction of a man-made wetland at Fred Fletcher Park in order to contain stormwater runoff from a 60-acre drainage area off of the major thoroughfare of Glenwood Avenue. 2007 CWMTF Successes Stormwater City of Raleigh, Pigeon House Branch Page 11 Stormwater management is not just an issue for North Carolina’s major cities, however. Smaller communities also face challenges in dealing with water pollution that results when rains runs across hard, paved surfaces and into the watershed. Improving stormwater management can be costly for towns that face the dilemma of balancing economic growth with protection of vital resources. One such community is the growing coastal town of Swansboro in Onslow County. In 2007, CWMTF fully funded the town’s $335,000 request to use stormwater management practices to protect and restore water quality in Hawkins Creek and the White Oak River. Page 12 Town of Swansboro, Hawkins Creek/White Oak River Basin The project implements recommendations made in the Hawkins Creek Restoration Planning Study, also funded by CWMTF. The plan mapped stormwater outfalls, identified and prioritized areas where best management practices could be effectively used to control runoff and identified buffer and corridors. 2007 grant funds will be used to target stormwater management in three drainage areas and to construct two small wetland areas and a retention pond to hold and filter rainwater before it flows into the creek and river. Wastewater treatment and handling projects comprised 20 percent of the grants funded by CWMTF in 2007, making it the largest funding category behind land acquisitions for the agency. CWMTF has established itself as an extremely valuable resource for communities struggling to adequately protect the state’s water resources while effectively dealing with increased wastewater treatment demands. In response to direction last year from the General Assembly, CWMTF trustees increased consideration given to low-income communities in funding wastewater collection system projects and wastewater treatment projects. Emphasis was placed on funding requests from the communities least able to afford wastewater treatment improvements. Economically distressed local government units received $33.1 million out of the $39.3 million in CWMTF funds awarded for wastewater projects in 2007. One of those communities was Harnett County, which received a $500,000 grant to help construct a pumping station, force main, gravity sewers, and wastewater treatment plant to eliminate failing septic systems and to facilitate regionalization of wastewater management. The project will have a significant effect on water quality in the Little River, since it will allow for better control over the amount of pollutants flowing into the river. Approximately 1,350 septic systems will be eliminated including approximately 180 failing septic systems. Similarly, CWMTF also awarded the city of Dunn $2.9 million to upgrade its wastewater treatment facility and protect water quality in Mingo Swamp. Page 13 Wastewater Harnett County Regional Wastewater Treatment, Little River Throughout its 11-year history, CWMTF has emphasized the value of creating, expanding and promoting the partnership approach to solving the state’s water quality problems. In 2007, CWMTF made its seventh grant award to continue the restoration efforts of a coalition in Haywood County working to address nonpoint source pollution in the Pigeon River Watershed. The Southwestern NC Resource Conservation and Development Council and its core partners, the Haywood Soil and Water Conservation District and the Haywood Waterways Association, have long been working to implement best management practices to restore streams and creeks and to address a wide variety of sedimentation issues to improve water quality in the region. The 2007 project expands the partnership to include the U.S. Environmental Protection Agency, the Tennessee Valley Authority and the N.C. Ecosystem Enhancement Program. The CWMTF grant for $504,000 will help improve water quality in the impaired Hyatt Creek Watershed through the buy-out of two farms on the major tributary of Oxner Creek. A hog operation located directly on the streambank will be purchased and demolished and an adjacent dairy farm will be closed down. The buy-out of the animal operations will significantly reduce the amount of nonpoint source pollution flowing into the creek. In addition, the project will establish approximately four acres of permanent conservation easements along streams in the watershed and restore approximately 2,830 feet of protective buffer area along the streams. The ultimate goal of the project is to remove Hyatt Creek from the state’s 303(d) list of impaired waters and improve the biological integrity of the watershed. The total effort in the Pigeon River Watershed demonstrates a commitment by all those involved to continue to share resources. It also shows that the conservation community and government agencies can and do work well with landowners and the community at large to solve problems. Page 14 Restoration Southwestern N.C. Page 1 In 2007, water issues once again came to the environmental forefront in North Carolina, as the state wrestled not only with one of its worst droughts in recent history, but with the potential for that drought to continue well into the next calendar year and beyond. Whenever water quantity becomes an issue, attention is focused on water quality as well, and the importance of protecting and preserving the state’s existing water resources is underscored. In the 11 years since its creation, the N.C. Clean Water Management Trust Fund has gained a reputation as one of the state’s premiere water conservation and protection agencies. In August 1996, the General Assembly approved landmark legislation creating the trust fund in response to public outcry over the polluted condition of the Neuse River. Since that time, CWMTF has played key roles in protecting water quality in all 17 of the state’s river basins, and has helped preserve key North Carolina landmarks such as Grandfather Mountain, Bird Island, DuPont State Forest, Chimney Rock, and the Alligator River. In 2007, CWMTF and its partners celebrated the conservation of Cowee Mound in Cherokee County, Jones Island in Carteret County, Lake Rhodhiss, the Neuse River in Wake County, and the completion of a major stormwater management project in Wilmington. During its consideration of grants in 2007, the CWMTF Board of Trustees refocused attention on providing low-income communities with resources to address their wastewater management needs, and it prepared to integrate innovative methods into the criteria for stormwater management grants in 2008. CWMTF also changed leadership during 2007. Following the resignation of Bill Holman in December 2006, Richard E. Rogers, Jr. was hired by the CWMTF Board of Trustees and became the fund’s third executive director. His appointment was effective August 1, 2007. Introduction Page 2 The General Assembly, in its legislation that enacted CWMTF (Chapter 113A Article 18 (GS 113A-251 et seq.)), gave the new agency a clear mandate: “to clean up pollution in the state’s surface waters and to protect and conserve those waters that are not yet polluted.” The CWMTF “shall be used to help finance projects that specifically address water pollution problems and focus on upgrading surface waters, eliminating pollution, and protecting and conserving unpolluted surface waters, including urban drinking water supplies” and “to build a network of riparian buffers and greenways for environmental, educational, and recreational benefit.” CWMTF’s influence on water quality over the last decade extends well beyond the Neuse River Basin. Conservation of forested buffers along key waterways, wastewater improvements, restoration of wetlands and stream banks to curb erosion and stormwater management for cities and towns has resulted in cleaner water for all of North Carolina – from Murphy to Manteo. CWMTF’s non-regulatory, incentive-based grants complement North Carolina’s environmental regulatory and educational programs and help ensure both a strong economy and healthy environment. The CWMTF is an independent agency housed for administrative purposes in the Department of Environment and Natural Resources (DENR). A 21-member board of trustees establishes criteria, allocates funds, reviews applications, approves grants, and hires the executive director. Seven members are appointed by the Governor; seven by the General Assembly upon the recommendation of the President Pro Tempore of the Senate; and seven by the General Assembly upon the recommendation of the Speaker Page 3 Background of the House. An advisory council composed of the Commissioner of Agriculture, Chair of the Wildlife Resources Commission, Secretary of DENR, and Secretary of Commerce or their designees advises the board of trustees. Local governments, state agencies, and nonprofit conservation organizations, such as land trusts, may apply for grants. Moneys from CWMTF may be used to acquire conservation easements or land in fee simple to preserve riparian buffers, wetlands, floodplains, and greenways; to restore riparian buffers, streams, and wetlands; to repair failing wastewater collection and treatment systems; to eliminate failing septic tanks and straight pipes; to prevent, reduce, collect and treat stormwater pollution; and to plan water quality projects. The board works through three principal committees: acquisitions, infrastructure/wastewater, and restoration/stormwater. The executive director, two deputy directors, real property counsel, wastewater infrastructure project manager, restoration and stormwater project manager, administrative officer, communications director, paralegal, executive assistant, and office assistant are based in the central office in Raleigh. Five field representatives cover the coast, piedmont and mountain regions of the state. In 2008, a part-time water quality advisor will be changed to a full-time position and moved to the central office and a stewardship coordinator will be added to the Raleigh CWMTF staff. Administration In 2007, the CWMTF continued to make significant strides in funding projects to improve water quality throughout the state. In the last year, CWMTF also continued to help the state achieve its goal of preserving a million acres of open space, as set out in GS 113A-240, and further assisted Governor Easley implement his One North Carolina Naturally initiative. As of 2007 CWMTF has: • helped preserve over 439,000 acres of land, thereby ensuring streams, rivers, lakes and shellfishing waters will be able to support their uses for drinking water, recreation, fisheries and other uses; • helped protect over 4,500 miles of riparian bufers; • invested more than $446.6 million in land and water conservation; • funded 135 riparian bufer, stream and wetland restoration projects totaling more than $85.2 million; • assisted local governments and other applicants with 232 wastewater improvement projects, investing more than $215.3 million to reduce discharges and more effectively treat wastewater so that fewer nutrients and other pollutants enter our rivers, and • funded 89 stormwater management projects totaling more than $48.3 million to reduce pollution from urban runoff and decrease flooding. Progress by the Numbers-2007 The Board of Trustees adopted an annual administrative budget of up to $2,222,400 for fiscal year 2007-2008 at its September 2007 meeting. In 2007, the Board of Trustees met eight times – five times in Raleigh, and in Chapel Hill, Browns Summit, and Marion. In 2008, the Board plans to meet for its off-site planning meeting in February in Durham and then three times in Raleigh and in Winston-Salem and in Hickory for its regular meetings Page 4 Protecting Natural and Cultural Heritage: Cowee Mound Page 5 In 2007, CWMTF celebrated the conservation of the Cowee Mound tract It is almost impossible to separate North Carolina’s natural heritage from its rich cultural heritage. Evidence of the role water resources have played in the development of the Tar Heel State’s cultural traditions is plentiful - one only has to look at the importance of the watermen in coastal Carolina, or of the Native Americans in the Appalachians. One of the best examples of this confluence can be found in Macon County. Cowee Mound, on the Little Tennessee River, is the heart of the ancient settlement of Cowee, a principle commercial center for the mountain Cherokee people. It was also the target of the first military campaign in the South during the American Revolution. In 2007, CWMTF and one of its most successful partners, the Land Trust for the Little Tennessee, celebrated the conservation of the Cowee Mound tract - 68 acres adjacent to the Needmore Gamelands, which extends the 35 miles of existing conservation along the Little Tennessee riverfront. The project, which received a $471,000 grant in 2005 from CWMTF, preserves not only the pristine waters of the Little Tennessee but the heritage of the area’s Cherokee tribe. From a water quality standpoint, preservation of Cowee Mound will prevent development from degrading water quality in one of the state’s cleanest rivers. The section of the river bordering the property is thought to be the only area in the Southern Blue Ridge Mountains retaining its full complement of native aquatic fauna. The river is a federally designated “Critical Habitat” for several important species, including the Spotfin Chub, the Appalachian Elktoe and Little-Wing Pearly Mussels. Protection of the site also preserves the state’s rich cultural heritage. For example, it will allow for the expansion of protective buffers of rivercane canebrake along the waterway. This plant is an important source of raw materials for modern day Cherokee artisans. The area is likely to become an important site for both ecotourism and heritage tourism, perfectly showcasing the connection between our state’s natural resources and its rich mountain traditions. Page 6 Budget and Funding None of CWMTF’s achievements in 2007 would have been possible without the support of the North Carolina legislature. The General Assembly continued its strong support for protecting and restoring water quality in 2007. The FY 2007-2008 budget approved by the legislature once again appropriated $100,000,000 in recurring funds to CWMTF in each year of the biennium. CWMTF will work to justify continued funding at this or an increased level during the remainder of the 2007-2009 biennium, to address the more than $17 billion of needs to protect and restore water quality in North Carolina. Grant Criteria and Low Income Communities In 2007, the CWMTF Board continued to improve CWMTF’s grant review criteria by integrating CWMTF’s existing criteria with the common criteria set out in Session Law 2005-454. As a result, in the 2007 grant cycle, more weight was given to good water quality applications from economically distressed local governments in the category of wastewater treatment grants. In this arena, the board demonstrated its commitment to following the direction of the General Assembly set out in GS 113A-254(a1) to give priority to applications for wastewater collection system projects and wastewater treatment works projects that serve economically distressed local government units. 2007 Legislative Action and Issues Page 7 Innovative Stormwater Management The 2007 General Assembly passed Senate Bill 1468 requiring CWMTF to fund innovative efforts to improve stormwater management. The CWMTF is focusing efforts to encourage innovative stormwater technology and will make funding those types of projects a priority in 2008. On March 1, 2007, CWMTF received 186 applications totaling $155 million, marking the first grant cycle since a decision in 2006 by CMWTF trustees to reduce the number of grant cycles per year from two to one. In addition to considering those new requests for water quality funding, 28 applications deferred from previous cycles were also eligible for consideration in the 2007 cycle, adding an additional $102 million to the amount requested from the agency. 2007 Summary of Projects Page 8 Key projects for the year included: $22.8 million to The Nature Conservancy and N.C. Wildlife Resources Commission to help conclude the historic purchase of the International Paper tracts on Juniper Creek in Brunswick County, and on the Tar, Chowan and Roanoke rivers; $2.4 million to the N.C. Wildlife Resources Commission to help purchase the GMS Tract on the Alligator River; $2.4 million to the Town of Murphy to purchase the Murphy Tract and protect Marble Creek; $3 million to the N.C. Division of Soil and Water Conservation for the continuation of the floodplain swine lagoon buyout program; $1 million to the City of New Bern for stormwater management to protect Jack Smith Creek; $1.9 million to help the Town of Eastover in Cumberland County make improvements to its wastewater treatment system and protect Locks Creek; $3 million to the Town of Burgaw to regionalize its wastewater treatment collection system and protect Burgaw Creek in Pender County; $2.4 million to the Town of Mt. Gilead to rehabilitate its wastewater collection system and protect Clarks Creek in Montgomery County; $2.9 million to the City of Dunn to upgrade its wastewater treatment facility and protect water quality in Mingo Swamp. Thanks to appropriations from the General Assembly and to the closing out of old grants, the CWMTF Board of Trustees approved 217 grants, awarding a total of $119 million, including additional funding awarded to 12 previously approved projects in calendar year 2007. In 2007, the CWMTF Board continued to approve a diverse mix of projects: 50 percent of the approved requests involved land acquisitions; 20 percent involved infrastructure/wastewater projects; 20 percent involved restoration/ stormwater; and the remainder of the 2007 grant awards involved planning projects. One of CWMTF’s most successful land acquisition partnerships continues to be with the N.C. Division of Parks and Recreation. Growth and development in North Carolina hinders NCDPR’s ability to expand. At the same time, it also threatens the state’s water resources. It makes good sense that these two agencies work together on behalf of North Carolina’s natural resources. In 2007, CWMTF awarded the division $4.6 million to help conserve almost 3,000 acres across the state, from South Mountains State Park in the western part of the state, to Pettigrew State Park in eastern North Carolina. Parks protected by CWMTF in 2007 include Eno River State Park, Lake Norman State Park, Merchants Millpond State Park, Pettigrew State Park, Stone Mountain State Park, South Mountains State Park, Lake Waccamaw State Park, and the newly authorized Deep River State Trail centered in Chatham County. “Each year, trustees for these conservation trust funds have become more adept at combining their efforts for effective conservation of our natural resources and support of the state’s One North Carolina Naturally initiative,” said Lewis Ledford, director of the division. “The critical properties to be acquired by these grants will help develop new parks and greatly enhance established parks.” The combined efforts for state parks in 2007 are directed at 24 tracts, the largest being a 1,082-acre property on the Scuppernong River at a newly designated section of Pettigrew State Park in Washington and Tyrell counties. 2007 CWMTF Highlights Acquisitions N.C. Division of Parks and Recreation: Additions to State Parklands Page 9 NC Division of Tourism In 2006, CWMTF joined with North Carolina Chapter of The Nature Conservancy and several other conservation partners to help purchase and preserve some of the most biologically sensitive areas of eastern North Carolina when the International Paper divested itself of its land holdings across the country. At that time, CWMTF invested more than $15.7 million to help purchase the property and protect water quality on well over 58,000 acres along the Roanoke, Chowan and Upper Tar rivers. In 2007, CWMTF helped complete the transaction by awarding another $22.8 million in the form of five grants – priority was placed on securing protection of these ecologically important lands and the finalization of the massive project was completed a year ahead of the expected schedule. The International Paper lands are a critical addition to the acres of stream and river front already under protection by many conservation agencies in the state. They are home not only to waterbodies critical to water quality in eastern North Carolina, but to a whole host of important species – from the endangered red-cockaded woodpecker and the fox squirrel to healthy populations of black bear and river otter. The waters of these rivers are important to North Carolina’s economy as well as its environmental health, as they support many facets of the state’s tourism industries and its fisheries. According to The Nature Conservancy, North Carolina’s acquisition was the largest part of the regional effort to secure the International Paper lands available in the entire Southeast –an effort which spanned 10 states and totaled 218,000 acres of ecologically important rivers, streams and forests. CWMTF is extremely proud to have played a role in this landmark conservation project. Stormwater continues to be one Pofa gNeo r1t0h The Nature Conservancy: International Paper Tracts Phase II Carolina’s biggest water pollution concerns, and nowhere is that more evident than in the state’s urban areas. In 2007, CWMTF awarded the City of Raleigh a $1.1 million grant to fund three stream enhancement projects to help manage stormwater in a center city watershed. The effort will make improvements in the Pigeon House Branch Watershed, which includes three neighborhood parks between the Cameron Park and Five Points neighborhood. Streams running through Smallwood Drive, Cowper Drive and Edna Metz Wells parks will be enhanced to help reduce erosion during heavy rains. The improvements will better manage stormwater runoff from a 450-acre area, most of which is paved surface. The project also includes construction of a man-made wetland at Fred Fletcher Park in order to contain stormwater runoff from a 60-acre drainage area off of the major thoroughfare of Glenwood Avenue. 2007 CWMTF Successes Stormwater City of Raleigh, Pigeon House Branch Page 11 Stormwater management is not just an issue for North Carolina’s major cities, however. Smaller communities also face challenges in dealing with water pollution that results when rains runs across hard, paved surfaces and into the watershed. Improving stormwater management can be costly for towns that face the dilemma of balancing economic growth with protection of vital resources. One such community is the growing coastal town of Swansboro in Onslow County. In 2007, CWMTF fully funded the town’s $335,000 request to use stormwater management practices to protect and restore water quality in Hawkins Creek and the White Oak River. Page 12 Town of Swansboro, Hawkins Creek/White Oak River Basin The project implements recommendations made in the Hawkins Creek Restoration Planning Study, also funded by CWMTF. The plan mapped stormwater outfalls, identified and prioritized areas where best management practices could be effectively used to control runoff and identified buffer and corridors. 2007 grant funds will be used to target stormwater management in three drainage areas and to construct two small wetland areas and a retention pond to hold and filter rainwater before it flows into the creek and river. Wastewater treatment and handling projects comprised 20 percent of the grants funded by CWMTF in 2007, making it the largest funding category behind land acquisitions for the agency. CWMTF has established itself as an extremely valuable resource for communities struggling to adequately protect the state’s water resources while effectively dealing with increased wastewater treatment demands. In response to direction last year from the General Assembly, CWMTF trustees increased consideration given to low-income communities in funding wastewater collection system projects and wastewater treatment projects. Emphasis was placed on funding requests from the communities least able to afford wastewater treatment improvements. Economically distressed local government units received $33.1 million out of the $39.3 million in CWMTF funds awarded for wastewater projects in 2007. One of those communities was Harnett County, which received a $500,000 grant to help construct a pumping station, force main, gravity sewers, and wastewater treatment plant to eliminate failing septic systems and to facilitate regionalization of wastewater management. The project will have a significant effect on water quality in the Little River, since it will allow for better control over the amount of pollutants flowing into the river. Approximately 1,350 septic systems will be eliminated including approximately 180 failing septic systems. Similarly, CWMTF also awarded the city of Dunn $2.9 million to upgrade its wastewater treatment facility and protect water quality in Mingo Swamp. Page 13 Wastewater Harnett County Regional Wastewater Treatment, Little River Throughout its 11-year history, CWMTF has emphasized the value of creating, expanding and promoting the partnership approach to solving the state’s water quality problems. In 2007, CWMTF made its seventh grant award to continue the restoration efforts of a coalition in Haywood County working to address nonpoint source pollution in the Pigeon River Watershed. The Southwestern NC Resource Conservation and Development Council and its core partners, the Haywood Soil and Water Conservation District and the Haywood Waterways Association, have long been working to implement best management practices to restore streams and creeks and to address a wide variety of sedimentation issues to improve water quality in the region. The 2007 project expands the partnership to include the U.S. Environmental Protection Agency, the Tennessee Valley Authority and the N.C. Ecosystem Enhancement Program. The CWMTF grant for $504,000 will help improve water quality in the impaired Hyatt Creek Watershed through the buy-out of two farms on the major tributary of Oxner Creek. A hog operation located directly on the streambank will be purchased and demolished and an adjacent dairy farm will be closed down. The buy-out of the animal operations will significantly reduce the amount of nonpoint source pollution flowing into the creek. In addition, the project will establish approximately four acres of permanent conservation easements along streams in the watershed and restore approximately 2,830 feet of protective buffer area along the streams. The ultimate goal of the project is to remove Hyatt Creek from the state’s 303(d) list of impaired waters and improve the biological integrity of the watershed. The total effort in the Pigeon River Watershed demonstrates a commitment by all those involved to continue to share resources. It also shows that the conservation community and government agencies can and do work well with landowners and the community at large to solve problems. Page 14 Restoration Southwestern N.C.
