State of InTobth Carolina, Department of State, Raleigh, December 1, 1908. To His Excellency, Robert B. Glenn, Govertior. Sir:—I have the honor, in compliance with the Constitu-tion, to submit to you a report concerning this department for the two years ending November 30, 1908, and to request you to transmit the same to the General Assembly. PUBLIC LANDS. Within the last two fiscal years there have been issued from this office 529 grants of public lands, on which account there has been paid to the Treasurer $16,025.19. The Revisal and Laws and Journals have been distributed, as the law directs. The supply of Volume II of the Revisal was exhausted. Five hundred more copies of that volume have been reprinted. On account of sale of the Revisal and Laws and Journals, there has been paid into the State Treas-ury $1,336.45. PUBLIC PRINTINCJ. There was an unusual delay in printing the Private Laws of 1907. This was due to several causes. Some years ago, when the contract was let by the Printing Commission for the State printing, the present State Printers made a bid for half the printing, stating that they were not equipped to do it all. The bid made by the present State Printers was the lowest bid, and the whole printing was turned over to them, with the understanding that they would enlarge their plant sufficiently to do the State's work. In 1907, after printing the Public Laws, the State Printers moved into a new four-story build- Secretary of State. 5 iiig, 60 X 100 feet, well equipped with up-to-date macbiuery. Some of the machinery broke down, and there were other delays incident to the removal. The Legislature of 1905 authorized the Supreme Court to contract for the prompt issue of its own Reports, provided they did not pay a higher price than was paid the State Printers. After much delay, annoyance and ineffectual ef-forts to have the work done, the Reports were brought back to the State Printers, who were already over-full with work. It Avas decided to allow the 144th Supreme Court Report to have right of way over the Private Laws of 1907, as it was deemed of more importance to get it out. This further greatly delayed the Private Laws. Ko other printer could be found to take the work at contract price. The character of work now done is the best the State ever enjoyed, and is done at less cost than ever before. The State Printers now claim that they are sufficiently equipped to do all State work promptly. The delay in printing caused in-convenience to parties interested in the Private Laws, and much annoyance and extra work upon the office of Secretary of State, as many certified copies had to be made. supreme court reports. During the last two fiscal years there has been paid into the State Treasury from the sale of Supreme Court Reports — For year ending November 30, 1907 .$ 7.044.45 For year ending November 30, 190S 7,617.29 $14,661.74 Under chapter 400, Public Laws of 1905, these Reports are now being printed under the direction of the Supreme Court, which is authorized to contract for the printing of its Reports, select the printer and prescribe terms of contract, etc. A number of the old Reports that are out of print are being-annotated by Judge Clark and reprinted. During the years 1907 and 1908 Volumes QQ, 69, 74, 80, 82, 83, 84, 85, 88, 89, 90, 92, 93, 113 and 126 have been reprinted. SIDEIS^OTIiSTG A:N'D INDEXING. Section 2733 of the Revisal of 1905 requires an assistant of the Secretary of State to index the laws and prepare the laws and captions for publication, and provides for the pay-ment of $500 for this work. This is insufficient pay for the work to be done. The laAvs are more than twice the vol-ume that they were a few years ago, and the pay is less. The followiuii' table will illustrate: ,, , ,„ t? With the greatly increased number of laws passed, and the largely increased bulk of the captions, it has been found necessary to index the captions. The sidenoting is also a very considerable work, requiring much time and considerable skill. Almost half the laws are passed at the close of the session, requiring much rush work and night work, and in the closing-weeks the Committee on Enrolled Bills cannot leave their duties in the House to examine and correct the enrolled bills with the care that should be given them ; so, notwithstanding the fact that there are competent proof readers in the Enroll-ing Office in the closing weeks of the General Assembly, many errors creep into the ratified copies. I recommend that the pay of this assistant be increased from $500 to $Y50, and that it also be made a part of his duties to carefully read, edit and prepare for the printer each act passed. This would insure much gTeater accuracy in the laws and would be an economy to the State. The work of preparing captions, making a synopsis of and indexing the same, and sidenoting and indexing the laws is now being done for less than it is worth. EXROLLMEXT OF BILLS. The present method of the enrollment of bills is a great improvement over the old system. They are now typewritten and a carbon copy made at the same time for the printers. These typewritten copies are bound in volumes, which are much handier than the old bulky volumes of handwritten bills. In my last report I called attention to the fact that more than half the bills passed in. 1905 were sent to the Enrolling Office in the last ten days of the session. This included many of the longest and most important bills, which caused an undue rush, much all-night work, and prevented to some extent the painstaking time that should have been given these bills to insure their accuracy. In 1907 this congestion 8 Biennial Report at the close of the session was even more marked than in 1005. At that session the General Assembly passed 1,535 acts ; 1,345 of these were ratified during the last twenty days of the session, 901 of them in the last ten days and 237 on the last day. In such rush work it is almost impossible to have it properly done. The Committee on Enrolled Bills cannot devote time to examining such a congested mass of bills without neglecting their duties on the floor of the General Assembly, and find it a |)hysical impossibility to read over these laws in the limited time they have. This congestion causes much crude legisla-tion and many inaccuracies. This should be avoided. The Secretary of State should be authorized to have a clerk or assistant carefully proof-read a second time every act passed by the General Assembly and prepare a correct coj)y for the printer, making such purely clerical corrections as do not change the law. This would be to the interest of the State and greatly facilitate the printing of the laws. I Avill here take the liberty to repeat a reconnnendation made two years ago, and will quote directly from my last report : "All bills should be printed daily as introduced, but this seems impracticable for want of adequate printing facilities. However, all important bills should be printed in large type, triple-spaced, with wide margins for notes and amendments. In amending, reference should be made to the words before and after the place where insertion is to be made, and espe-cially is this true of supplemental acts. In engrossing a bill the numbers and relative positions of the lines are changed, again the lines are changed in enrolling, and again changed in printing; so reference to the number of line is meaningless and often leads to confusion and errors. '*As the handwriting of the members is not always so clear and legible as to prevent misreading, all bills should be type-written when introduced—the public bills at State expense and private bills at cost of interested parties. Seceetaey of State. 9 ''Typewritten bills and resolutions passing without amend-ment should be enrolled without being engrossed, as such a course will save the State considerable unnecessary expense. This was done to a large extent last session, but it should be-come the invariable rule. "As I said in my last report, if the Engrossing Depart-ments of the House and Senate were combined and made into one department, and the copying therein done with type-writers, it would be in the interest of accuracy and economy. The Chief Engrossing Clerk and assistants could be appointed by the Speaker of the House and President of the Senate." The Journals should be printed daily and a copy placed on the desks of the members of the Legislature every morning. The State Printers inform me that they are now sufficiently equipped to meet this requirement. HALL OF RECOEDS. For more than a quarter of a century each Secretary of State has called attention to the need of a proper place for the storage of the many thousands of dollars worth of books be-longing to the State. The books have been corded in piles in various rooms about the city and subject to damage and dangers of many kinds. The Laws and Supreme Court Re-ports are now stored on the fourth floor of the LTzzell build-ing, in a hall 60 x 100 feet, for which the State is paying a rental of $2-i0 a year. The number of books is annually in-creasing, and the State should make provision for properly caring for the same. The Board of Public Buildings added the large room on the third floor of the northeast side of the Capitol, formerly occu-pied by the Insurance Commissioner, to the rooms of the State Department, but this is now more than full of old manuscript journals, laws and valuable documents of many kinds. The Secretary of State now shares that with the Historical Com-mission. The large room on the southwest side of the third floor of the Cajiitol was some years ago made a part of the offices 10 Biennial Report allotted to the Department of State. This room is filled with official records, maps, manuscripts, priceless documents, old bills and acts of the General Assembly, etc. During sessions of the General Assembly it is used as an enrolling office. In the old closets of the Capitol there are many thousands of valuable papers that should be properly filed if space per-mitted. There is no space in the Capitol to arrange for the books and documents that are now overflo^^ing every department, and a fireproof Hall of Records should be built to care for the highly perishable property that the State has now on hand. Many manuscripts, papers, books and historical relics would be donated to the State if a proper repository was provided for their safedvceping. TKADE-MARKS. For the two years ending ISTovend^er 30, 1908, nineteen trade-marks have been registered. A list of these will be found at another place in this report. BANKS. Under chapter 7, Revisal of 1905, sixty-seven banks have been incorporated, a list of which appears elsewhere in this report. EAILROADS. The following fourteen railroad companies have filed arti-cles of association in this office, according to chapter 61 of the Revisal of 1905, during the last two fiscal years : 1. FOREIGX CORPORATIONS. Under section 1194, chapter 21, Revisal of 1905, eighty-eight foreigTi corporations filed statements and copies of char-ters and paid entrance taxes for two years ending ]Srovember 30, 1908. There have been 1,602 certificates for domestic corporations filed in the ofiice of the Secretary of State for the past two years, on which $41,229.50 as organization and dissolution taxes has been paid. A certificate under seal is given upon filing statement. For every seal affixed fifty cents is required by law to be paid into the Treasury, so out of every dollar collected for filing statement, fifty cents of same is credited to seal account, as shown above. Note.—The amounts of money received by this department (except for entries of vacant lands) are paid to the Treasurer on the first of the month following the month in which they are collected, and so appear in his accounts. For instance, money received by the Secretary of State for November, and entered in the November accounts of this office, appears in the December accounts of the Treasurer, and so for the other months of the year.
