Session Laws — 1995 CHAPTER 631 of Education shall certify to tiie State Treasurer from time to time Uie extent to which the match requirements of this section have been met with respect to each county; tiiis certification shall be binding and conclusive. Bond proceeds shall be disti-ibuted for expenditure only as, and to tiie extent, die matching requirements of tiiis section are satisfied, as certified by tiie State Board of Education. The State Board of Education shall also require counties to report annually on tiie impact of funds provided under tiiis act on tiie property tax rate for tiiat year. These reports shall be public documents and shall be furnished to any citizen upon request. (e) Unmatched Proceeds. -- If tiie State Board of Education determines tiiat a county has not met tiie matching requirements of this section by January 1, 2003, witii respect to any bond proceeds allocated under subsection (c) of tiiis section, tiie State Board of Education shall certify tiiat fact to tiie State Treasurer by March 1, 2003. Amounts tiiat are allocated in tiie Growth Allocation of bond proceeds under subsection (c) of tiiis section and tiiat have not been matched by January 1, 2003, as certified by the State Board of Education, shall be reallocated among tiie counties tiiat are allocated bond proceeds under tiie Growtii Allocation and have met tiie matching requirements for their total Growth Allocation. The reallocation shall be made among tiie eligible counties in proportion to tiie amount of Growtii Allocations for tiiose counties under subsection (c) of this section. Amounts tiiat are allocated in tiie ADM Allocation of bond proceeds under subsection (c) of tiiis section and tiiat have not been matched by January 1, 2003, as certified by tiie State Board of Education, shall be reallocated among tiie counties tiiat have met tiie matching requirements for tiieir total ADM allocation. The reallocation shall be made on tiie basis of average daily membership of tiie local school administi-ative units witiiin tiie remaining counties. Bond proceeds reallocated to a county because of a local school administi-ative unit's average daily membership witiiin tiie county may be used only witii respect to public school capital outiay projects of tiiat unit. Bond proceeds reallocated to a county under tiiis subsection must be matched at tiie same rate as bond proceeds allocated to the county under subsection (d) of tiiis section. (f) Administi-ation. -- Funds disbursed under tiiis act shall be administered and supervised by tiie State Board of Education and shall be used only for tiie purposes provided in tiiis act. Each school administi-ative unit shall submit to tiie State Board of Education its plans for tiie expenditure of ftinds allocated under tiiis act. After tiie State Board of Education determines tiiat a school administrative unit's planned expenditiire of part or all of tiie funds allocated to it is witiiin tiie purposes provided in tills act, tiie State Board of Education shall make the funds to which tiie plans apply available to tiie school administi-ative unit. Allocations to tiie costs of a capital improvement or undertaking in each case may include allocations to pay the costs set forth in Section 3(2)c., d., e., f., and g. of tiiis act in connection witii tiie issuance of bonds for that capital improvement or undertaking. Sec. 7. Election. -- The question of the issuance of tiie bonds autiiorized by tiiis act shall be submitted to tiie qualified voters of tiie State at a statewide election to be held November 5, 1996.
