John C. ]\hingum, being sworn, says : I have been at the Penitentiary about two years. I was present and assisted to gag Rhody Foster. J. S. Penny and Colonel Faribault particij^atcd. She was under gag about twenty minutes ; I think the intention was to gag her for thirty minutes, but a shower of rain coming up she was re-leased before the expiration of the time. She walked away after she was released, and said "it did not hurt her a bit," but hurt her feelings. I saw her the next day in the wash room where she remained about two weeks before she was taken sick. I don't know how long she was sick before she died. At the time she was gagged Jesse Holden was on beat No. 3. I saw Granville Ferrell wearing ball and chain they were removed by order of Dr. Hill. I do not know how long he lived after they were removed. I saw no cru-elty or inhumanity toward the convicts. Saw no sport made of the convicts while undergoing punishment.
