Regulating the practice of massage and bodywork therapy and its educational institutions, for the protection of the public. NORTH CAROLINA BOARD of MASSAGE & BODYWORK THERAPY Message from the Board Chair, Holly Foster, LMBT This has been a challenging and rewarding year for the North Carolina Board of Massage and Bodywork Therapy; challenging by way of the number of investigations of complaints and rewarding by way of new legislation that provides the Board with the ability to regulate massage and bodywork therapy establishments. The Board receives complaints each month of illicit activity by non-licensed persons as well as licensed massage and bodywork therapists across the State. Each complaint is taken seriously and is investigated thoroughly. The Board’s duty is public protection and this is but one way it is carried out. The Board has been working closely with police and sheriff’s departments across the State to educate them on the laws governing the practice of massage and bodywork therapy in North Carolina. In instances where illicit activity by LMBTs and unlicensed persons has been discovered, the Board and these departments are working together to stop the activity and punish those responsible. With the new charge by the legislature to regulate massage and bodywork therapy establishments, the Board has begun to develop rules that will implement that regulation. This is an ongoing process that requires input from stakeholders, submission to the Rules Review Commission, and open hearings. I encourage your participation in this endeavor. NCBMBT’s Top 10 List of Reminders for all LMBT’s 1. Please keep the Board informed of any changes to your mailing address and email address so you will be sure to receive all pertinent information, such as renewal reminders, newsletters, etc. 2. For all up-to-date information, as well as Board contact information and/or questions regarding licensure, please refer to the NCBMBT website at www.bmbt.org. 3. The Board meets every other month on the 13th floor of the Wells Fargo Capital Center, 150 Fayetteville Street, Raleigh, NC 27601. The current meeting schedule is posted on the website under ‘Board Meetings’. All Board meetings are open to the public. 4. You can now file a complaint online by going to the Filing a Complaint tab on the Board’s websi t e . 5. You can access the License Renewal tab on the Board’s website to print copies of your license. Log in with your name and password you created when you originally renewed online. 6. All online renewals end on December 31 at midnight. Any renewals submitted past this date will need to be mailed and include a letter stating whether or not you have been practicing massage and bodywork therapy in NC since your license expired. 7. To keep your license current, all LMBTs must complete 24 hours of continuing education, including a minimum of 3 hours of ethics, through an approved provider. You may take a maximum of 12 hours of distance learning and a maximum of 8 hours of business management, should you choose to do so. 8. Any LMBT who has completed all of the required CEU’s during the year of their renewal may apply any additional CEU’s taken after August 1 of that year to their next renewal period, as long as they were not submitted for the prior renewal period. 9. You can verify a LMBT’s license is valid in NC by accessing the Board’s website, clicking on the License Verification tab and searching by their last name or license number. 10. Meetings begin at 10:00 a.m. and are open to the public. There is a 15 minute period of Public Comment at the end of each meeting. Those interested in addressing the Board during Public Comment must sign up in person before or during the meeting. NEW BOARD MEMBER Tim Moore, Speaker of the House, appointed Rachael Goolsby of New Hanover County to the position previously held by Melissa Smith. Her term began on July 1, 2017 and will end June 30, 2018. Rachael Goolsby: Rachael Goolsby is a North Carolina native. After high school she went directly to massage school and has been practicing for 25 years. She began her yoga studies as a teenager, and today leads her own advanced teacher training called Mountains to Sea AYTT300, in addition to teaching weekly classes, seasonal workshops and nourishing retreats. She is also a CE Provider for Thai Massage, which she has been studying and practicing for 24 years. Rachael thrives on the dynamic, powerful and self-sustaining combination of teaching yoga and practicing massage. She is certified through Yoga Alliance (YA 500-ERYT (2007)& YACEP) and has been a NC LMBT since 2002. The holistic influence of Cayce/Reilly School of Massage (1993) provided a strong foundation for Rachael’s work. Her studies in yoga are comprehensive, including many asana styles and Eastern philosophy. She earned her BFA in Dance & Choreography from VCU (2002). She continues to dance with the Dance Cooperative in Wilmington, NC and loves to weave, sew and work with natural dyes. Rachael is happiest when she is either making or healing with her hands! Her love of movement, healing and self-inquiry enhance her life as a mother to two wonderful, strong and creative girls and as a wife to her husband Thom. She is honored to be appointed to the Board to serve the invaluable profession of massage and bodywork. NEW BOARD OFFICERS The Board, at its June 2017 meeting, elected the following officers: Chair – Holly Foster Vice Chair – Nancy Harrell Treasurer – Dianne Layden KEEP INFORMATION UP TO DATE To optimize communications between the Board and licensees, please update your current email address at the Information Update tab on the Board’s website www.bmbt.org.3 Licensure of Establishments The North Carolina Legislature passed Senate Bill 548 in July 2017 that provided the NC BMBT will be responsible for overseeing and licensing establishments that provide massage and bodywork therapy services. We encourage you to go online to read Senate Bill 548 and to attend Board meetings where you can keep up to date on discussions and decisions of the Board as licensure of establishments is implemented. See the Board’s website for dates of meetings and past meeting minutes. The Board encourages your participation. Here is a projected timeline for the Establishment License implementation process. 4/19/18 – Public Hearing on rules 5/14/18 – End of comment period 6/21/18 – Board reviews comments and approves final rule submission 9/1/18 – Effective date of rules The Board’s mission is to: “ensure the protection of the health, safety, and welfare of the citizens of this State receiving massage and bodywork therapy services”. The Board will be able to utilize the Establishment license to stop individuals that are running a business that does not meet the requirements set forth in Senate Bill 548. Some of those requirements are: 1. Requirements for adequate, safe, and sanitary facilities. 2. Requirements for compliance with local building code require ments, State fire safety codes, and State health inspection codes nec essary to ensure the safe and effective practice of massage and body work therapy. 3. Requirements for retention of client and ownership records. 4. Requirements that its employees or independent contractors be currently licensed by the Board. We have heard LMBTs, in phone calls, emails and letters, express concern over businesses that are operating in a manner that does not represent legal massage therapy and bodywork. We will now be able to inspect and have hearings for those who own these businesses. All too often, we have had hearings for those pretending to be licensed massage and bodywork therapists. These persons have either been willingly operating illegally or have been victims of human trafficking. Either way, until establishment licensure, the Board had limited ways to discipline those who owned and ran these businesses. We hope you will see the value in elevating the profession while also protecting the public. Thanks to those of you who have supported the Board in making massage and bodywork therapy an honorable and legal healthcare profession.New Reach Course In the summer of 2017, the NCBMBT began collaborating with the FSMTB to develop a course through the FSMTB REACH program. According to the FSMTB website: The Regulatory Education and Competence Hub or REACH, is an online learning management system that houses regulatory-focused educational courses and services for the Federation’s member boards. When opened to the public, REACH can be found on the FSMTB website. REACH serves several functions for the Federation including offering public safety courses for license renewal and remediation courses for disciplinary actions by its member boards. Each course is available for mobile devices and designed following best practices for adult learning using interactive multimedia experiences that engage the learner and deepen understanding of the content. The Board requested that FSMTB create a course in Client Intake and Documentation. This broad topic will be covered in four separate courses, client communication, documentation, client intake and legal issues. The Board will use the course primarily for remediation and discipline purposes. When a therapist comes before the Board for disciplinary purposes and it is determined that the therapist will benefit from remediation in one of these areas, one or more of the courses will be assigned for completion. The anticipated availability date of the course is June, 2018. Art of Healing License Required Senate Bill 548 clarifies that a LMBT is required to obtain an Art of Healing license from the North Carolina Department of Revenue: “Every individual in this State who practices a profession or engages in a business and is included in the list below must obtain from the Secretary a statewide license for the privilege of practicing the profession or engaging in the business. The tax for each license is fifty dollars ($50.00) and includes a physician, a veterinarian, a surgeon, an osteopath, a chiropractor, a dentist, an ophthalmologist, an optician, an optometrist, a massage and bodywork therapist, or another person who practices a professional art of healing.” The need for, enforcement of and understanding of this Art of Healing license has been spotty, at best, up until now. With this change, LMBTS are now considered healthcare professionals in the State of North Carolina. 4HEARINGS BEFORE THE BOARD: Ronald Inch – Following a hearing on June 15, 2017, upon engaging in inappropriate physical contact with a client and provided improper draping during a massage and bodywork therapy session, the Board Ordered that Mr. Inch’s license will not be renewed and he can reapply in two years and he pay a civil penalty of $1000 and costs of $1000. Alexander Somov - Following a hearing on June 15, 2017, upon engaging in inappropriate physical contact with several co-workers during massage and bodywork therapy sessions, the Board Ordered that Mr. Somov’s license be reprimanded and he pay a civil penalty of $500 and costs of $250. Jahquiis Alston - Following a hearing on June 15, 2017, upon engaging in inappropriate sexual activity with a client during a massage and bodywork therapy session, the Board Ordered that Mr. Alston’s license be revoked and he pay a civil penalty of $1000 and costs of $1000. Yan Liang - Following a hearing on August 17, 2017, upon aiding and abetting illegal massage and bodywork therapy activity at her place of business, the Board Ordered that Ms. Liang’s license be revoked and she pay a civil penalty of $1000 and costs of $750. Russell Sanders - Following a hearing on December 14, 2017, upon engaging in inappropriate sexual contact with clients during massage and bodywork therapy sessions and pleading guilty to sexual battery, the Board Ordered that Mr. Sanders’ license be revoked and he pay a civil penalty of $2000 and costs of 1000. Jiayu Shelton - Following a hearing on December 14, 2017, upon aiding and abetting illegal massage and bodywork therapy activity at her place of business, the Board Ordered that Ms. Shelton’s license be revoked and she pay a civil penalty of $1000 and costs of $1000. CONSENT ORDERS: Redesa Batts – Prior to a hearing scheduled for February 16, 2017, Ms. Batts entered into a Consent Order for engaging in an inappropriate relationship with a client wherein her license was revoked and she agreed to pay a civil penalty of $1000 and costs of $500. Sherrie Cameron – Prior to a hearing scheduled for February 16, 2017, Ms. Cameron entered into a Consent Order for practicing massage and bodywork therapy without a current license wherein she agreed to pay a civil penalty of $250 and costs of $100. Brian Christopher – Prior to a hearing scheduled for February 16, 2017, Mr. Christopher entered into a Consent Order for engaging in inappropriate sexual contact with a client during a massage and bodywork therapy session wherein his license was revoked and he agreed to pay a civil penalty of $500 and costs of $250. Jennifer Hart – Prior to a hearing scheduled for February 16, 2017, Ms. Hart entered into a Consent Order for practicing massage and bodywork therapy without a current license wherein she agreed to pay a civil penalty of $500 and costs of $250. Sheri Simpson – Prior to a hearing scheduled for February 16, 2017, Ms. Simpson entered into a Consent Order for practicing massage and bodywork therapy without a current license wherein she agreed to pay a civil penalty of $250 and costs of $100. Jinpeng Wu – Prior to a hearing scheduled for February 16, 2017, Mr. Wu entered into a Consent Order for aiding and abetting illegal massage and bodywork therapy activity at his place of business wherein his license was reprimanded and he agreed to pay a civil penalty of $300 and costs of $150. Jasmine Jerome – Prior to a hearing scheduled for February 16, 2017, Ms. Jerome entered into a Consent Order for causing injury to a client through cupping techniques wherein she agreed to pay a civil penalty of $750 and costs of $250. Joey Diaz – Prior to a hearing scheduled for February 16, 2017, Mr. Diaz entered into a Consent Order for engaging in inappropriate sexual activity with clients during massage and bodywork therapy sessions wherein his license was revoked and he agreed to pay a civil penalty of $1000 and costs of $500. Katrina Snow – Prior to a hearing scheduled for April 20, 2017, Ms. Snow entered into a Consent Order for failing to notify the Board of criminal charges against her co-worker and employee wherein she agreed to pay a civil penalty of $150 and costs of $100. Virgil Rogers – Prior to a hearing scheduled for April 20, 2017, Mr. Rogers entered into a Consent Order for failing to notify that Board of criminal charges wherein he agreed to pay a civil penalty of $250 and costs of $150. Yuan Zhang - Prior to a hearing scheduled for April 20, 2017, Ms. Zhang entered into a Consent Order for aiding and abetting illegal massage and bodywork therapy activity at her place of business wherein her license was revoked and she agreed to pay a civil penalty of $1000 and costs of $500. Four (4) applicants were denied a license due to criminal charges pending or being on probation: Brianna Bingermann, Jeremy Drye, Angela Reed and Cydni Thibodeaux. Three (3) applicants were denied a license because the curriculum of the massage school they attended did not meet the Board’s minimum requirements: Robert Dickson, Raquel Ortega and Rhoda Paysnick. One (1) applicant was denied a license since they did not appear before the License Standards Committee for their interview: Travis Blocker. CONDITIONAL LICENSES: The License Standards Committee of the Board issued thirty-six (36) Conditional Licenses to persons whose applications showed evidence of past minor criminal behavior, possibility of practicing without a license, education deficiency or other minor improper conduct.9 The website provides an easily accessible source for information on the licensing program and activities of the Board. Full Text | Regulating the practice of massage and bodywork therapy and its educational institutions, for the protection of the public. NORTH CAROLINA BOARD of MASSAGE & BODYWORK THERAPY Message from the Board Chair, Holly Foster, LMBT This has been a challenging and rewarding year for the North Carolina Board of Massage and Bodywork Therapy; challenging by way of the number of investigations of complaints and rewarding by way of new legislation that provides the Board with the ability to regulate massage and bodywork therapy establishments. The Board receives complaints each month of illicit activity by non-licensed persons as well as licensed massage and bodywork therapists across the State. Each complaint is taken seriously and is investigated thoroughly. The Board’s duty is public protection and this is but one way it is carried out. The Board has been working closely with police and sheriff’s departments across the State to educate them on the laws governing the practice of massage and bodywork therapy in North Carolina. In instances where illicit activity by LMBTs and unlicensed persons has been discovered, the Board and these departments are working together to stop the activity and punish those responsible. With the new charge by the legislature to regulate massage and bodywork therapy establishments, the Board has begun to develop rules that will implement that regulation. This is an ongoing process that requires input from stakeholders, submission to the Rules Review Commission, and open hearings. I encourage your participation in this endeavor. Please keep the Board informed of any changes to your mailing address and email address so you will be sure to receive all pertinent information, such as renewal reminders, newsletters, etc. 2. For all up-to-date information, as well as Board contact information and/or questions regarding licensure, please refer to the NCBMBT website at www.bmbt.org. 3. The Board meets every other month on the 13th floor of the Wells Fargo Capital Center, 150 Fayetteville Street, Raleigh, NC 27601. The current meeting schedule is posted on the website under ‘Board Meetings’. All Board meetings are open to the public. 4. You can now file a complaint online by going to the Filing a Complaint tab on the Board’s websi t e . 5. You can access the License Renewal tab on the Board’s website to print copies of your license. Log in with your name and password you created when you originally renewed online. 6. All online renewals end on December 31 at midnight. Any renewals submitted past this date will need to be mailed and include a letter stating whether or not you have been practicing massage and bodywork therapy in NC since your license expired. 7. To keep your license current, all LMBTs must complete 24 hours of continuing education, including a minimum of 3 hours of ethics, through an approved provider. You may take a maximum of 12 hours of distance learning and a maximum of 8 hours of business management, should you choose to do so. 8. Any LMBT who has completed all of the required CEU’s during the year of their renewal may apply any additional CEU’s taken after August 1 of that year to their next renewal period, as long as they were not submitted for the prior renewal period. 9. You can verify a LMBT’s license is valid in NC by accessing the Board’s website, clicking on the License Verification tab and searching by their last name or license number. 10. NEW BOARD MEMBER Tim Moore, Speaker of the House, appointed Rachael Goolsby of New Hanover County to the position previously held by Melissa Smith. Her term began on July 1, 2017 and will end June 30, 2018. Rachael Goolsby: Rachael Goolsby is a North Carolina native. After high school she went directly to massage school and has been practicing for 25 years. She began her yoga studies as a teenager, and today leads her own advanced teacher training called Mountains to Sea AYTT300, in addition to teaching weekly classes, seasonal workshops and nourishing retreats. She is also a CE Provider for Thai Massage, which she has been studying and practicing for 24 years. Rachael thrives on the dynamic, powerful and self-sustaining combination of teaching yoga and practicing massage. She is certified through Yoga Alliance (YA 500-ERYT (2007)& YACEP) and has been a NC LMBT since 2002. The holistic influence of Cayce/Reilly School of Massage (1993) provided a strong foundation for Rachael’s work. Her studies in yoga are comprehensive, including many asana styles and Eastern philosophy. She earned her BFA in Dance & Choreography from VCU (2002). She continues to dance with the Dance Cooperative in Wilmington, NC and loves to weave, sew and work with natural dyes. Rachael is happiest when she is either making or healing with her hands! Her love of movement, healing and self-inquiry enhance her life as a mother to two wonderful, strong and creative girls and as a wife to her husband Thom. She is honored to be appointed to the Board to serve the invaluable profession of massage and bodywork. We encourage you to go online to read Senate Bill 548 and to attend Board meetings where you can keep up to date on discussions and decisions of the Board as licensure of establishments is implemented. See the Board’s website for dates of meetings and past meeting minutes. The Board encourages your participation. Here is a projected timeline for the Establishment License implementation process. 4/19/18 – Public Hearing on rules 5/14/18 – End of comment period 6/21/18 – Board reviews comments and approves final rule submission 9/1/18 – Effective date of rules The Board’s mission is to: “ensure the protection of the health, safety, and welfare of the citizens of this State receiving massage and bodywork therapy services”. The Board will be able to utilize the Establishment license to stop individuals that are running a business that does not meet the requirements set forth in Senate Bill 548. Some of those requirements are: 1. Requirements for adequate, safe, and sanitary facilities. 2. Requirements for compliance with local building code require ments, State fire safety codes, and State health inspection codes nec essary to ensure the safe and effective practice of massage and body work therapy. 3. Requirements for retention of client and ownership records. 4. Requirements that its employees or independent contractors be currently licensed by the Board. We have heard LMBTs, in phone calls, emails and letters, express concern over businesses that are operating in a manner that does not represent legal massage therapy and bodywork. We will now be able to inspect and have hearings for those who own these businesses. All too often, we have had hearings for those pretending to be licensed massage and bodywork therapists. These persons have either been willingly operating illegally or have been victims of human trafficking. Either way, until establishment licensure, the Board had limited ways to discipline those who owned and ran these businesses. We hope you will see the value in elevating the profession while also protecting the public. Thanks to those of you who have supported the Board in making massage and bodywork therapy an honorable and legal healthcare profession.New Reach Course In the summer of 2017, the NCBMBT began collaborating with the FSMTB to develop a course through the FSMTB REACH program. According to the FSMTB website: The Regulatory Education and Competence Hub or REACH, is an online learning management system that houses regulatory-focused educational courses and services for the Federation’s member boards. When opened to the public, REACH can be found on the FSMTB website. REACH serves several functions for the Federation including offering public safety courses for license renewal and remediation courses for disciplinary actions by its member boards. Each course is available for mobile devices and designed following best practices for adult learning using interactive multimedia experiences that engage the learner and deepen understanding of the content. The Board requested that FSMTB create a course in Client Intake and Documentation. This broad topic will be covered in four separate courses, client communication, documentation, client intake and legal issues. The Board will use the course primarily for remediation and discipline purposes. When a therapist comes before the Board for disciplinary purposes and it is determined that the therapist will benefit from remediation in one of these areas, one or more of the courses will be assigned for completion. The anticipated availability date of the course is June, 2018. Art of Healing License Required Senate Bill 548 clarifies that a LMBT is required to obtain an Art of Healing license from the North Carolina Department of Revenue: “Every individual in this State who practices a profession or engages in a business and is included in the list below must obtain from the Secretary a statewide license for the privilege of practicing the profession or engaging in the business. The tax for each license is fifty dollars ($50.00) and includes a physician, a veterinarian, a surgeon, an osteopath, a chiropractor, a dentist, an ophthalmologist, an optician, an optometrist, a massage and bodywork therapist, or another person who practices a professional art of healing.” The need for, enforcement of and understanding of this Art of Healing license has been spotty, at best, up until now. With this change, LMBTS are now considered healthcare professionals in the State of North Carolina. 4HEARINGS BEFORE THE BOARD: Ronald Inch – Following a hearing on June 15, 2017, upon engaging in inappropriate physical contact with a client and provided improper draping during a massage and bodywork therapy session, the Board Ordered that Mr. Inch’s license will not be renewed and he can reapply in two years and he pay a civil penalty of $1000 and costs of $1000. Alexander Somov - Following a hearing on June 15, 2017, upon engaging in inappropriate physical contact with several co-workers during massage and bodywork therapy sessions, the Board Ordered that Mr. Somov’s license be reprimanded and he pay a civil penalty of $500 and costs of $250. Jahquiis Alston - Following a hearing on June 15, 2017, upon engaging in inappropriate sexual activity with a client during a massage and bodywork therapy session, the Board Ordered that Mr. Alston’s license be revoked and he pay a civil penalty of $1000 and costs of $1000. Yan Liang - Following a hearing on August 17, 2017, upon aiding and abetting illegal massage and bodywork therapy activity at her place of business, the Board Ordered that Ms. Liang’s license be revoked and she pay a civil penalty of $1000 and costs of $750. Russell Sanders - Following a hearing on December 14, 2017, upon engaging in inappropriate sexual contact with clients during massage and bodywork therapy sessions and pleading guilty to sexual battery, the Board Ordered that Mr. Sanders’ license be revoked and he pay a civil penalty of $2000 and costs of 1000. Jiayu Shelton - Following a hearing on December 14, 2017, upon aiding and abetting illegal massage and bodywork therapy activity at her place of business, the Board Ordered that Ms. Shelton’s license be revoked and she pay a civil penalty of $1000 and costs of $1000. CONSENT ORDERS: Redesa Batts – Prior to a hearing scheduled for February 16, 2017, Ms. Batts entered into a Consent Order for engaging in an inappropriate relationship with a client wherein her license was revoked and she agreed to pay a civil penalty of $1000 and costs of $500. Sherrie Cameron – Prior to a hearing scheduled for February 16, 2017, Ms. Cameron entered into a Consent Order for practicing massage and bodywork therapy without a current license wherein she agreed to pay a civil penalty of $250 and costs of $100. Brian Christopher – Prior to a hearing scheduled for February 16, 2017, Mr. Christopher entered into a Consent Order for engaging in inappropriate sexual contact with a client during a massage and bodywork therapy session wherein his license was revoked and he agreed to pay a civil penalty of $500 and costs of $250. Jennifer Hart – Prior to a hearing scheduled for February 16, 2017, Ms. Hart entered into a Consent Order for practicing massage and bodywork therapy without a current license wherein she agreed to pay a civil penalty of $500 and costs of $250. Sheri Simpson – Prior to a hearing scheduled for February 16, 2017, Ms. Simpson entered into a Consent Order for practicing massage and bodywork therapy without a current license wherein she agreed to pay a civil penalty of $250 and costs of $100. Jinpeng Wu – Prior to a hearing scheduled for February 16, 2017, Mr. Wu entered into a Consent Order for aiding and abetting illegal massage and bodywork therapy activity at his place of business wherein his license was reprimanded and he agreed to pay a civil penalty of $300 and costs of $150. Jasmine Jerome – Prior to a hearing scheduled for February 16, 2017, Ms. Jerome entered into a Consent Order for causing injury to a client through cupping techniques wherein she agreed to pay a civil penalty of $750 and costs of $250. Virgil Rogers – Prior to a hearing scheduled for April 20, 2017, Mr. Rogers entered into a Consent Order for failing to notify that Board of criminal charges wherein he agreed to pay a civil penalty of $250 and costs of $150. Four (4) applicants were denied a license due to criminal charges pending or being on probation: Brianna Bingermann, Jeremy Drye, Angela Reed and Cydni Thibodeaux. Three (3) applicants were denied a license because the curriculum of the massage school they attended did not meet the Board’s minimum requirements: Robert Dickson, Raquel Ortega and Rhoda Paysnick. One (1) applicant was denied a license since they did not appear before the License Standards Committee for their interview: Travis Blocker. CONDITIONAL LICENSES: The License Standards Committee of the Board issued thirty-six (36) Conditional Licenses to persons whose applications showed evidence of past minor criminal behavior, possibility of practicing without a license, education deficiency or other minor improper conduct.9 The website provides an easily accessible source for information on the licensing program and activities of the Board.
