an act to repeal an act entitled an act pro viding for the appointment of engrossing clerk : which was read the first time mr daniel irom the committee appoin ted to superintend the election for en grossing clerk reported that there was ction mr thomas of davidson moved that a message be sent to the house of com mons proposing to go into an election for united states senator on thursday next at 12 o'clock ; which was determined in the negative by yeas and nays as fol lows : yeas 23 ; nays 24 another unsuccessful vote for engross ing clerk then took place the hour of 12 o'clock having arrived one county to another referred to the committee on the judiciary mr williams of mecklenburg present ed a bill to condemn a part of hayne street in the town of monroe for the pur pose of building a jail referred to the committee on propositions and grievances air satterthwaite of pitt moved to re consider the resolution introduced on yes terday by mr hayes in favor ofthe sher iff of cherokee in order that an amend ment to the resolution might be proposed carried mr hayes then olfered the following amendment — to take elfect from and after its passage adopted mr ellis of rowan presented a bill to incorporate the town of salisbury re ferred to the committee on private bills mr courts of rockingham presented a report from the committee on propositions and grievances recommending the pas sage ofthe bill in relation to the division of stokes county — one part to be called stokes and the other forsyth county air stanly objected to the name pro posed for one of the two counties he thought there were many sons of north carolina whom we had never honored whose names might appropriately be giv en to counties and was opposed to going out ofthe state to find names why he asked should we go to georgia after a name to give to a county of north caro lina ? at this point of air s's remarks air courts arose and said that the name pro posed was that of a son of north caroli na — of one who gallantly fought in the last war with great britain and fell upon our northern frontier air stanly then moved an amendment by inserting this in the preamble air steele of richmond was indispos ed to vote on the bill until he had heard an explanation of the reasons for division he hoped that some friend of the bill would set forth before the house their ob ject for desiring its passage air ellis of rowan presented certain reasons which the reporter did not dis tinctly hear air satterthwaite of pitt as one of the committee to whom the bill had been re ferred went at some length into the rea sons that influenced his support ofthe bill he said he knew there was a jealousy on the part ofthe east in regard to the divis ion ofthe large counties ofthe west a rising from the fear that the representa tion of that part of the state would be greatly increased thereby but in the pre sent case there need be no fear for he believed there would be no increase ol strength the county of stokes having at present three commoners would in all probabilitv bv the proposed division have only two that part to be called the coun tv of stokes one and that part to be call ed the county of forsyth one a strong reason said mr s why the bill ought to pass is that the memorial is signed l>v over a thousand respectable citizen anil the fact that the division of the county was made a test question in the august elections and was fairly decided by a ma jority of tbe votes the citizens of the county complained of being burdened and they ought to he relieved if the count v as it now stands be a grievance the bill ought to pass ; and he for one was always ready to relieve the people of a burden no matter from what quarter the petition for relief might come mr courts moved to insert the chris tian name of for>yth and said that he as chairman ofthe committee presented the report in obedience to the wishes of the committee mr stanly inquired of mr courts whether he was in favor ofthe hill or not ' and said that from the last remark ofthe gentleman from rockingham there was much doubt whether he approved of it or not mr courts replied by saying lhat he was a neighbor to tuesday nov 28 senate a message was received from the house of commons agreeing to the proposition of the semite to appoint a joint select committee on ihe part ol each house to report rules of ordi r for their joint gov ernment : and informing this body that messrs mebane dancy and j ii white form the committee on the part of that house messrs patterson watson and woo ten appointed the committee on the part of the senate also a message proposing that the two houses vote forthwith for engrossing clerk which message was concurred in an he senate voted accordingly mr lane introduced a bill entitled an act to repeal an act entitled an act pro viding for the appointment of engrossing clerk : which was read the first time mr daniel irom the committee appoin ted to superintend the election for en grossing clerk reported that there was ction mr thomas of davidson moved that a message be sent to the house of com mons proposing to go into an election for united states senator on thursday next at 12 o'clock ; which was determined in the negative by yeas and nays as fol lows : yeas 23 ; nays 24 another unsuccessful vote for engross ing clerk then took place the hour of 12 o'clock having arrived lie senate proceeded to vote for secreta ' rv of state as follows for william hill 41 : for jo watson 2 alter another unsuccessful vote for en . grossing clerk mr halsey from the committee ap pointed to superintend the election of se cretary of state reported that william ' hill having received a majority of the whole number o votes was duly elected a message was received from the house ol commons transmitting certain docu ments from other states which accompa nied the governor's message with a pro position to refer them to a joint select committee which was agreed to and llie following announced as the commit ; tee on the part of the senate viz : messrs ashe lillington conner davidson and another ballotting was then had for ssing clerk the name of mr tho mas having been withdrawn from the nomination ; when mr bryan was duly elected a message was received from his ex cellency the governor transmitting the vote of the several counties of the state in the recent presidential election c which on motion of mr halsey was or dered to be laid upon the table the senate then adjourned house of commons the house met this morning pursuant to adjournment the journal of the preceding day hav ing been read mr williams of new hanover moved that a message be sent to the senate to go into the election of engrossing clerk and informing that body that the name of mr ingram was withdrawn the chair announced as the commit lee on the part of the house to propose rales for the government ofthe two hous es the following gentlemen viz : messrs mebane dancy and j ii white — the committee on part of the senate consists of messrs patterson watson a wooten mr biggs of bertie presented a me morial from sundry citizens of bertie which on motion was referred to the committee on reading mr shuford of lincoln introduced a bill and memorials in relation to the an nexation ot a part of burke county to catawba mr mcintosh of iredell presented a petition in favor of ann patterson engrossing clerk another message was received stating the names of messrs lewis simmons whitaker and ingram were withdrawn the following persons were then left in nomination messrs bryan moore thomas from each house to consider so much of tbe governor's message as relates to chero kee lands a message was received from the sen ate containing a communication from the secretary of state in relation to the pub lic printing the chair presented a communication in relation to the division of stokes coun ty which on motion of mr courts of rockingham was referred to committee on propositions and grievances mr hicks of macon introduced a res olution in favor of isaiah cook and others — referred to committee on claims the chair presented a communication from the treasurer transmitting his re port xmr mebane of orange moved to dis pense with the reading of the report and that it be sent to the senate with a pro position to print mr ferebee of camden introduced a resolution to send a message to the sen ate to raise a joint select committee to take into consideration that part of the governor's message relating to an agri cultural geological and mineralogical survey ofthe state mr farmer from the committee on election of clerk reported that there was no election mr steele of richmond moved to send a message proposing to proceed to anoth er election a message was received from the sen ate proposing to go into ihe election of secretary of state at 12 o'clock to day concurred in a message was received from the sen ate agreeing to go into an election of en grossing clerk committee on the part of the house to superintend election messrs catmichael and keene the chair presented a message from the governor in relation to the resigna tion of justices of the peace which on ter of revised statutes which on mo tion of mr stevenson of craven was re ferred to committee on judiciary mr cherry of bertie introduced a re solution to refer that portion of the gov ernor's message in relation to common schools to the committee on education mr steele of richmond introduced a resolution to refer so much of the gover nor's message as relates to appointing a " thanksgiving day to a joint select com mittee the committee on election reported that there was no election of engrossing clerk a message was received from the se nate naming a committee on the part of that body to senate on propositions and grievances-messrs walker albright worth exum eborn reich daniel on claims — messrs conner rendall wright thomas of davidson spicer willey moye on the judiciary — messrs woodfin ashe washington graham smith ro gers gilmer on internal improvement alessrs pat terson thomas of haywood thompson of bertie murchison miller berry da vidson on education and the literary fund — messrs shepard bethel joyner collins lillington faison wooten joint committee on finance on the pa it of the senate — alessrs drake smavv hawkins lane hester gilmer wooten watson on thefjjibrary three of each house — j alessrs smith graham and ward air patterson from the joint select com mittee on joint rules made a report which was read and an explanation having been made by air patterson of amendments proposed by the committee the question was taken upon the adoption of the joint rules as reported and determined in the affirmative mr walker from the committee ap pointed to report rules for the govern ment ofthe senate made a report which was read ; and being explained by air walker the question upon the adoption of the rules as reported was deecided in the affirmative air patterson then moved that a mes sage be sent to the house of commons with a proposition to print the joint rules and the rules of each house together with the constitution c for the use of the mem bers which was agreed to air kendal presented a resolution in structing the commitee on the judiciary to inquire into the expediency of providing that witnesses who are summoned to give testimony before a clerk taking an ac count in cases against guardians and oth ers and before a clerk and master of e quity be allowed the same payment and mileage as witnesses in suits in court and that the same be termed a part ofthe costs and that the same committee en quire into the expediency of ascertaining by law the compensation to be allowed clerks and alasters for taking depositions and that they report by bill or otherwise a message was received from the house of commons proposing that so much of the govrnor's message as refers to a day of thanksgiving be referred to a commit tee of live on the part of the house and three on the part of the senate ; and that so much of said message as refers to brig gen nash and gen wm davidson be referred lo a committee of three on the part of the house and two on the part of the senate ; which propositions were a greed to air shepard offered the following res olut'on : lb solved that the governor be reques ted lo communicate to the legislature the particulars ofthe arrangement alluded to in his message by which " a company might be organized to embrace the en tire line from gaston to charlotte and the road now owned by the state transferred to them at a fair valuation in payment of her subscription for stock air shepard briefly explained the ob ject of his resolution which was then a dopted the speaker announced a message from the house of commons transmitting a memorial of aliss dix upon the subject of a lunatic asylum ; with a proposition to print and that said memorial be refer red to a joint select committee the reading of the memorial was dispensed with and the proposition to print agreed to the following committee on the part ofthe senate was subsequently announ ced : alessrs washington hawkins pat terson thomas of haywood conner woodlin and bower the speaker also announced a message from the house of commons transmitting the resignation of justices of the pea.ce : also proposing to refer so much of the gov ernor's message as relates to a geologi cal and afineralogical survey of the state to a joint select committee of five on the part of each house : also transmitting the report of charles l hinton public trea surer with a proposition to pi t agreed to mr 3/urchison presented a resolution for the relief of the county court clerk of cumberland : — which was read the first time and referred to the committee on propositions and grievances mr gilmer moved that a message be sent to the house proposing on monday next at 12 o'clock to go into an el ction for united states senator mr wood fin called for the yeas and nays on this motion which being taken resulted as follows : yeas 25 ; nays 24 the speaker voting in the negative the motion was lost on motion of mr walker the senate adjourned house of commons the house met according to adjourn ment the journal having been read mr mosely of warren moved lo reconsider the resolution oflerred by him on yester day in relation to the erection of a 1/on ument in the capitoljsqare the house refused to reconsider mr j/cdowell of bladen introduced a bill to locate the judges of the superior courts hereafter to be elected referred to the committee on judiciary mr barringer of cabarrus moved for a reconsideration ofthe resolution offer ed on yesterday by the gentleman from gates with a view of instructing the committee to report a bill in favor ofthe recommendation by the governor the motion did not prevail mr campbell of iredell introduced a bill to incorporate the trustees of snow creek male academy referred to the committee on education mr dancy of edgecomb introduced a resolution lo raise a joint select commit tee to take into consideration the services of those sons of north carolina who dis tinguished themselves in the recent war with mexico mr hayes of cherokee introduced a resolution requiring the treasurer and comptroller to furnish certain statements in relation to cherokee lands mr hayman of beaufort introduced a bill to prevent execution on lands iu cer tain cases which on motion ofmr haves was referred to the committee on the ju diciary mr hicks presented a bill for the relief of witnesses in law suits removed from one county to another referred to the committee on the judiciary mr williams of mecklenburg present ed a bill to condemn a part of hayne street in the town of monroe for the pur pose of building a jail referred to the committee on propositions and grievances air satterthwaite of pitt moved to re consider the resolution introduced on yes terday by mr hayes in favor ofthe sher iff of cherokee in order that an amend ment to the resolution might be proposed carried mr hayes then olfered the following amendment — to take elfect from and after its passage adopted mr ellis of rowan presented a bill to incorporate the town of salisbury re ferred to the committee on private bills mr courts of rockingham presented a report from the committee on propositions and grievances recommending the pas sage ofthe bill in relation to the division of stokes county — one part to be called stokes and the other forsyth county air stanly objected to the name pro posed for one of the two counties he thought there were many sons of north carolina whom we had never honored whose names might appropriately be giv en to counties and was opposed to going out ofthe state to find names why he asked should we go to georgia after a name to give to a county of north caro lina ? at this point of air s's remarks air courts arose and said that the name pro posed was that of a son of north caroli na — of one who gallantly fought in the last war with great britain and fell upon our northern frontier air stanly then moved an amendment by inserting this in the preamble air steele of richmond was indispos ed to vote on the bill until he had heard an explanation of the reasons for division he hoped that some friend of the bill would set forth before the house their ob ject for desiring its passage air ellis of rowan presented certain reasons which the reporter did not dis tinctly hear air satterthwaite of pitt as one of the committee to whom the bill had been re ferred went at some length into the rea sons that influenced his support ofthe bill he said he knew there was a jealousy on the part ofthe east in regard to the divis ion ofthe large counties ofthe west a rising from the fear that the representa tion of that part of the state would be greatly increased thereby but in the pre sent case there need be no fear for he believed there would be no increase ol strength the county of stokes having at present three commoners would in all probabilitv bv the proposed division have only two that part to be called the coun tv of stokes one and that part to be call ed the county of forsyth one a strong reason said mr s why the bill ought to pass is that the memorial is signed l>v over a thousand respectable citizen anil the fact that the division of the county was made a test question in the august elections and was fairly decided by a ma jority of tbe votes the citizens of the county complained of being burdened and they ought to he relieved if the count v as it now stands be a grievance the bill ought to pass ; and he for one was always ready to relieve the people of a burden no matter from what quarter the petition for relief might come mr courts moved to insert the chris tian name of for>yth and said that he as chairman ofthe committee presented the report in obedience to the wishes of the committee mr stanly inquired of mr courts whether he was in favor ofthe hill or not ' and said that from the last remark ofthe gentleman from rockingham there was much doubt whether he approved of it or not mr courts replied by saying lhat he was a neighbor to the citizens of stokes and theretore did not desire to take part in the contest about the division of ihe county but hoped merely to give a silent vote in favor of the bill on moiion of 1/r keene of rocking ham the memorial was read and the bill passed its 2d reading mr \\ illiamson of columbus present ed a bill in relation to entries on vacant lands referred to the committee on the judiciary mr biggs of bertie presented a bill to incorporate the bertie guards a report from the joint select committee on rules was sutnuitted and concurred in a message was received from the sen ate proposing to print the joint rules of order the constitution of the state and the constitution of the united states in pamphlet form — one for each member — concurred in mr white of lincoln presented a bill to grant the superior courts ofthe coun ties ol lincoln and caston jurisdiction on all jury cases in said counties on motion of mr hicks of cherokee the house adjourned until to-morrow 10 o'clock and administrators which passed iis first reading and was refened to the commitiee on the judiciary mr gilmer introduced a bill lo incorporate dutch rivercopper mining and smelling com pany which passed its first reading mr rowland introduced a bill lo establish lumberton academy in the counly of robeson and to incorporate the trustees thereof which passed its first reading and was referred to the commi'tce on education the chair announced a message irom the house of commons enclosing certain pension certificates which were ordered to be counter signed by ihe speaker a bill lo repeal an act entitled an act to pro vide for ihe appointment of engrossing clerk was taken up and read ihe second time it was debated briefly by mes*rs joyner and kendall afier which it was rejected a bill lo authorize the county court of hal ifaz to sell and convoy the lot in the town ol halifax upon which the old courthouse is sit uated was taken up and read the second tin and after an explanation by mr
